Dear Mr. Randazza:

The Commission has issued the enclosed Amendment No.105 to Facility Operating License No. DPR-36 for the Maine Yankee (MY) Atomic Power Station. This amendment consists of changes to the Technical Specifications (TS) in response to your application dated March 24, 1988.

This amendment changes the maximum nominal enrichment of the fuel allowed to be used in the reactor core for operating cycle 11 and beyond from 3.5%

nominal weight U-235 to 3.7% nominal weight U-235.

Based upon your application, the staff understands that operation of the reactor with 3.7% nominal weight U-235 will be analyzed in the Cycle 11 Core Performance Analysis Report, scheduled-for submittal in July 1988. This amendment is approved, based on a review of the fuel storage methodology and the licensee's assertion that "preliminary results from an evaluation of the core loading planned for Cycle 11 (including a fresh fuel enrichment of 3.7 weight percent U-235) indicates that all applicable acceptance criteria will be met." Operation of the Maine Yankee reactor with 3.7% nominal weight U-235 fuel is not permitted until the licensee has completed the Cycle 11 Core Performance Analysis Report, and if there are changes in applicable acceptance criteria or in any technical specifications, until the NRC has authorized such changes.

As described in the staff's Safety Evaluation, we have concluded that the 4.13 and 3.72 percent enrichment values for the Phase I and II racks are acceptable limits for MY fuel assembly storage and that therefore acceptable spent fuel storage is available for the 3.7 percent enriched fuel of the proposed "Reactor Core" TS change. It is noted that, with the TS limit at 3.7 percent and presumably therefore no greater than 3.7 fuel avollable, either the Phase I or II racks may be used for fuel storage. However, if in the future greater than 3.73 percent fuel is to be stored, information on the procedures used to assure that the higher enrichment is stored only in Phase I racks should be presented for staff review.
