WATERFORD-3: ALLEGED RECEIPT OF FALSIFIED RESUME REPORT NUMBER: Q4-84-036

1. On August 3,1984, G. L. CONSTABLE, NRC Resident Reactor Inspector assigned to the Waterford-3 nuclear power station, Taft, Louisiana, telephonically apprised reporting investigator of the Louisiana Power &

Light Company (LP&L) receipt of an employment resume which was falsified by the job applicant. At CONSTABLE's suggestion, Joseph SLEGER, Executive Assistant to the Senior Vice President of LP&L, was telephonically contacted by reporting investigator concerning the allegedly falsified resume.

2. SLEGER advised that LP&L had recently received an employement application and resume from who purported to have extensive management and engineering experience with various companies involved in the construction of four sdifferent nuclear power plants. SLEGER explained that the LP&L review cf resume disclosed several points which aroused suspicion as to credibility. SLEGER stated listed himself as a recipient of the in the U.S. Marine Corps, although he had only 4 years military service. SLEGER stated that a check through sources with U.S. Marine Corps headquarters disclosed that these statements in resume were false. SLEGER stated that LP&L does iict intend to hire 1
3. At reporting investigator's request, SLEGER forwarded a copy of i employment application and resume to the Office of Investigatiohs Field l Office, Region IV. These documents are appended as Exhibit (1).
4. Insomuch as resume lists Marble Hill Nuclear Generating Station, Wolf Creek Power Generating Station, Midland Nuclear Power Plant, and San Onofre Nuclear Power Plant as former places of employment, this report is forwarded to the NRC Office of Investigations Field Offices, Region III and Region V for information and action deemed appropriate.
5. No further investigation of this matter is planned by the Region IV Office of Investigations.

We appreciate the opportunity to assist the Atomic Safety and Licensing Appeal Board in this matter and trust this letter provides a sufficient response to your comunication of December 19, 1984. The Office of Investigation stands ready to provide the Appeal Board in an ex parte, in camera session any information developed by 01 relevant and material to the Board's inquiry. As there are several ongoing 01 investigations being conducted regarding the Waterford project, there is a considerable amount of preliminary information already developed. There is also a substantial amount of investigative effort to be accomplished before the 01 investigations are concluded.

At this point, there is no information which might be disclosed to the parties under protective order. Information which even arguably at this juncture may appear appropriate for such disclosure may, as an investigation progresses, take on a new or different meaning thus negating the appropriate basis for its present disclosure.

Premature disclosure to parties, even under protective order, provides at least the potential for discovery of the lines of investigation, the opportunity for the tailoring of testimony, and ultimately a debasing of the integrity of the investigative process. Indeed, the licensing process is best served by i complete record, yet the record can never be N complete if the premature release of information thwarts the further collection of that very information.

ORDER l Pending before us are two motions to reopen the record, filed in this proceeding by Joint Intervenors. One concerns the adequacy of the concrete basemat on which the Uaterford facility rests, and the other seeks to raise three new contentions relating to quality assurance, the integrity of applicant's management, and the adequacy of the NRC staff's inspection and investigation efforts in connection with the plant. See ALAB-786, 20 NRC __ (Oct. 2, 1984); ALAB-792, 20 NRC __ (Dec. 12, 1984).

Within the last several weeks we have received two Board Notifications from the staff informing us that the Commission's Office of Investigations (OI) has recently initiated two new investigations that assertedly have some bearing on matters raised by both motions to reopen. Board Notification Nos. BN-84-184 (Dec. 5, 1984) and BN-84-187 g k/1 0 M y ,p. .

2 (Dec. 13, 1984). These investigations are in addition to nine others under way since early 1984. See NUREG-0787, Supplement No. 7, Safety Evaluation Report (Sept. 1984), at 2, 15. Because of the subject matter involved, neither the staff nor OI has provided us or the parties with any details of these investigations.. We have been advised, however, that OI is prepared to brief us on each of its ongoing investigations in an ex parte, in camera session.

The Commission has a policy and procedures for handling conflicts between the agency's need to protect investigative material from premature public disclosure, on the one hand, and, on the other, the duty of all parties (including the NRC staff) to disclose to adjudicatory boards and parties information that may be relevant and material to a pending proceeding. See 49 Fed. Reg. 36,032 (1984).1 The present situation compels us to invoke those procedures. The staff I

The Commission's policy emphasizes the general rule that all potentially relevant and material information should be disclosed to the boards and parties. It nonetheless recognizes that conflicts are inevitable and that a means to resolve them is necessary. It therefore has determined that preliminary ex parte, in camera inspection of the material at issue, by the board, is the most effective way of dealing with the problem. The Commission policy also stresses that information presented to a board ex parte cannot serve as the basis for an adjudicatory decisior.. Finally, the Commission itself has retained the authority for deciding if and when disclosure of the disputed information will occur. 49 Fed. Reg. at 36,033-34.
