Docket Nos. 50-382 Subiect: WITHDRAWAL OF PROPOSED civil PENALTY AND . RECONSIDERATION OF ENFORCEMENT ACTION 98-022 l

This is to inform the Commission that on May 24,1999 the staff withdrew a proposed civil penalty of $110,000 associated with a proposad June 16,1998 enforcement action. The enforcement action concerned Severity Levelill problems associated with an emergency core cooling system and the auxiliary feedwater system. For the emergency core cooling system the licensee identified that flow instrumentation had more uncertainty than what had been accounted for and for the auxiliary feedwater system the licensee had changed the flowrate in the approved analysis without NRC review and approval.  !

On July 29,1998 the licensee denied the violations. While the staff considered the licensee's response, it was not the primary factor in the reconsideration of the enforcement action. The violations surrounding the emergency core cooling system issue were determined to be based on an inappropriate application of 10 CFR 50.46, " Acceptance criteria for emergency core cooling systems for light-water nuclear power reactors." In addition, the staff's view on the margin of safety issue associated with 10 CFR 50.59,

" Changes, tests, and experiments," has changed since the enft,rcement action was proposed. Therefore, the violations assocated with 10 CFR 50.46 and 10 CFR 50.59 were withdrawn and the remaining violations conceming test control and corrective actions were recategorized at Severity Level IV.

The State of Louisiana has been notified.
