ENCLOSURE 1 NOTICE OF VIOLATION l

50-382 Waterford Steam Electric Station, Unit 3 License No.: NPF-38 During an NRC inspection conducted on September 14-18,1998, one violation of NRC requirements was identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:
License Condition 2.E of the Waterford Steam Electric Station, Unit 3, Operating License NPF-38 dated December 19,1995, requires that the licensee fully implement and maintain in effect the Commission approved physical security plan, including amendments and changes made pursuant to the authority of 10 CFR 50.54(p).
Paragraph 6.1.1 of the physical security plan, Revision 18, states,"Each zone of E-Field equipment is designed to detect an individual weighing 35 kilograms whether crawling or rolling under the lower sensing wire, stepping orjumping between the field and sensing l
wires, orjumping over the top sensing wire." Further, it states, "Each zone of microwave is designed to detect an individual weighing 35 kilograms crawling, walking, running, jumping or rolling between the transmitter and receiver at a rate between.15 and 5 meters per second."
Contrary to the above, performance tests of the protected area detection system identified that two detection zones did not meet design criteria to detect test individuals.
A microwave zone was defeated during two out of three jump tests. An E-field zone was defeated by three separate step through tests.
This is a Severity Level IV violation (Supplement Ill) (382/9816-02).
The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence, and the date when full compliance was achieved is already adequately addressed on the docket in the attached report.
