November 30, 1983 Note to Bob Perch

SUBJECT:

- SUSQUEHANNA EXTENSION DEADLINE... EQUIPMENT QUALIFICATION (0ELDf839052)

Why don't you go ahead and notice this thing now - that is, notice what the

. applicant requested. However, when it comes to acting on the request, I disagree with what'the staff intends to do in this case.

I can see no basis

for deferring the qualification of this equipment to an undefined date in the future.

If qualification protection against a scram discharge volume line break is covered by 50.49, then 50.49 governs the dates and the licensee's proposed request is unacceptable.

If this equipment is not covered by 50.49,

-I no of no regulatory basis for this Agency to imposed a requirement for qualifying that equipment.

In either event, the particular request by the licensee is unacceptable. The staff must now decide, now, decide whether or not this particular break is in fact a break' governed by 50.49.

If it is not governed by 50.49, then there is no regulatory basis for imposing equipment qualification for this equipment.

If the staff wishes to impose such a requirement,.they can do it by amending 50.49.
