SUBJECT:
MCGUIRE DIESEL GENERATOR. TESTS & TURBINE VALVE SURVEILLANCE (DELD # 838 345)
I have a number of problems with this package.
1.
I see no basis in the SER for denial of the licensee's request to change the diesel test from 18 months to every refueling outage. I don't think the explanation given on the bottom of page 1 justifies a denial.-
2.
However, since you are denying his request for an application you must publish a formal Federal Register notice of denial pursuant to 2.108 providing that the applicant and any person whose interest may be affected have 30 days to request a hearing.

With respect to the testing of the turbine valves I have trouble with the SER's indication that this license is being amended to authorize monthly testing "on an interim basis" and on the dondition that the licensee
- continues to use only AVP. I see no such conditions in the tech spec amend-
' ment or in any license condition. Consequently, it is incorrect to characterize this amendment as issued on the basis of those limitations or conditions.
