SUBJECT:

. PEACH BOTTOM AMENDMENT ON REACTOR PROTECTION SYSTEM OELD has been asked to concur in a Peach Bottom license amendment related.to the reactor protection system.

Notice of consideration of part of the amendment was published in the Federal Register on October 26, 1983 (48 FR 49591). ~ Unfortunately, that notice did not reference or describe a modification to the amendment application submitted by licensee on September 29, 1983.

That September 29 modification changed

certain setpoints that would go in the tech. specs. relative to the setpoint values requested by licensee in the application letters referenced in the Federal Register notice.

Because the Federal Register notice for this package neither fully

< described the changes we now propose to approve nor informed the public as to where all of the changes requested by licensee could be reviewed,

.that noi. ice is inadequate for the changes we would now issue. While the

- 'SER does indicate that the September 29, 1983 changes are more Y conservative than those noticed and-the proposed NSHC-finding would also apply tolthe September 29, 1983 changes, that. does not alter the fact that (1) the October 26 Federal Register notice did not inform the public of the September 29 proposed license changes and (2) the preposed NSHC finding in the October 26 Federal Register-notice' was not made specifically with regard to the September 29 changes.

I believe that, before this'.amendmer? package can be issued, an

- additional Federal Register notice' describing the September 29 change and providing a. proposed NSHC finding and basis is required.

Absent the additional notice, I am not prepared to concur in the issuance of this

package.
