February 9,1984 Note to Ed Reeves
SUBJECT:
FARLEY l - RELIEF FM ASME CODE REQUIREMENTS (0 ELD # 841 823)
Don Hassell has marked up the cover letter to reflect typographical errors.
In addition, you have to decide where it is you're granting the relief.
The Federal Register Notice says that you're granting the relief in the cover letter. The-cover letter, however, doesn't seem to grant the relief.
It tells them of. the status of the review and doesn't ever use words granting them the~ relief.
It suggests that the Safety Evaluation identifies the things for which relief is granted. The Safety Evaluation doesn't seem to use words that grant the relief. Please figure out someplace a grant the relief.
It should be in the cover letter.
If you don't put it in the cover letter,
- you are going to have to have someone sign the SER. The relief should be granted by an identified person. Since we don't sign SER's anymore, the SER is~ not a good place to grant the relief.
I would suggest you insert a paragraph in the cover letter granting them the relief requested (you can C
indicate that the details are. spelled out in the SER).
I think I know what you're attempting to do but you need to use some language in the cover letter which grants the relief involved here.
If you need any help drafting some-thing, talk to Don Hassell, the lawyer on the case.
