Dear Mr. Murphy:

In response to'your letter of 4 October, 1991, I have a great deal of problems with it, as well as some reiterations that need to be made.

How can you consider a matter closed' that has, yet, to be addres -

sed?- The report you refer to states with a clarity that Mr. Lopez did not conduct any interviews of the witnesses, nor did he go to Ira-dell, only, that he attempted-- to obtain some materials f rom me, and was refused,.and that he was denied access to my home. My complaints to your_ office had'nothing to do with uy home,.therefore this complaint is.still unaddressed.

Mr. Lopez contacted me by telephone, and stawed he knew nothing about any referral-from the NRC, and then we discussed my complaints in detail. That conversation was taped, and I enclose a transcipt of it for your information. I request that you pay special attention to the portion wherein we are discussing toxics and radioactivity, and note that he is incomplete agreement with me.- But there vas-no on-site. inspection' conducted.

With regard to your last paragraph in your letter to me, let me paraphrase it in more apropos terms: "You vere responsive (i.e. you wrote me a letter), however, you were irreponsible with regard to my concerns (i.e. you failed to even address them). You take your safe-ty-responsibilities to the public very seriously (i.e. on the reports l

of the-public, when viable, and involving Comanche Peak, you vill bury

them as deeply and as quickly as you can, in order that C .P .S .E .S .

29. where you would turn to the right and go down just a little ways, 30.
31. -probably about half a mile, and there is this stagnet pond-there.

33. (pause).And, that's where I obtained materials in a glass jar.

43. FLANAGIN: The water [ deep sigh], I do not have possession of at this 44.

11. FLANAGIN: I drove right up onto the property, put these samples 12.
13. in the trunk of my car. So, if they're radioactive, now my car is 14.
15. radioactive. Plus, my shoes I wore out to the property, and my 16.
17. home is, I guess, you know. [ contaminated) 18.
19. LOPEZ: Well, it, it vould depend, ah, really on, ahh, (sigh) 20.
21. on the extent of, ah, contamination if there was some

25. something is really serious enough that the EPA would be covering 26.
27. it up and telling us not to ever go out there again. And the

-29. Criminal Investigative Unit of the FBI is telling us not to ever go 30..

31. out there again. Now, if they had kindly told me that they 32.
33. suspected radiation, which I never dreamed, I would never have 34.
35. exposed myself to thic!

41. LOPEZ: But, ah, who said that, ahh, suspected radiation? The, what 42,
43. I'm trying to get, to find out 44.
45. FLANAGIN: Well, a reading on a radiation monitor is suspecting 46.

9. the neighbors do have health problems. Ahh, the Ovens that live 10.
11. .directly behind the property and closest to the water. Ah, she has 12.
13. had skin cancers sinct she built her home there. Ahh, when she sent 14.
15. her water, drinking vater off to be sampled, the test results never 16.
17. came back, so just to be sure, they don't drink the water, but they 18.
19. do bathe in it.. her, ahh, 15 year old son has very serious bronchial 20.
21. asthma. Ahh, a 4H project that he had in school where he ra' sed

- 23.- chickens (pause) they died. Ahh, there are, there were armadillos 24.

25.- out there that vent belly-up and armadillos, from all the research-26,

27. that I've done, carry leprosy. So, if - it they're not next to a
