Dear Mr. Murphy:
In response to'your letter of 4 October, 1991, I have a great deal of problems with it, as well as some reiterations that need to be made.
How can you consider a matter closed' that has, yet, to be addres -
sed?- The report you refer to states with a clarity that Mr. Lopez did not conduct any interviews of the witnesses, nor did he go to Ira-dell, only, that he attempted-- to obtain some materials f rom me, and was refused,.and that he was denied access to my home. My complaints to your_ office had'nothing to do with uy home,.therefore this complaint is.still unaddressed.
Mr. Lopez contacted me by telephone, and stawed he knew nothing about any referral-from the NRC, and then we discussed my complaints in detail. That conversation was taped, and I enclose a transcipt of it for your information. I request that you pay special attention to the portion wherein we are discussing toxics and radioactivity, and note that he is incomplete agreement with me.- But there vas-no on-site. inspection' conducted.
With regard to your last paragraph in your letter to me, let me paraphrase it in more apropos terms: "You vere responsive (i.e. you wrote me a letter), however, you were irreponsible with regard to my concerns (i.e. you failed to even address them). You take your safe-ty-responsibilities to the public very seriously (i.e. on the reports l
of the-public, when viable, and involving Comanche Peak, you vill bury
- them as deeply and as quickly as you can, in order that C .P .S .E .S .
l vill not have its license in jeopardy) and [yes] you will continue to do so within [or without] the bounds of your unlawful, and usurped in-l i

' authority, which are, in my opinion, boundless."
By copy of this letter, I am so informing Chairman Selin of the -i U.S. Nuclear legulatory Commission in Washington. In closing I would remind you_to look at the last three vords of paragraph 3 of your let-ter to me. . I expect, and demand, further action on this complaint. .
Sincerely, l

- 48.

4.
5.- FLANAGIN: No, this was, who was that? Mr. Boyd, W.E. Boyd and ;
6.
- 7. Dan Jackson. Now, whnt -I can tell you for certain is that all of 8.
- 9. the neighbors do have health problems. Ahh, the Ovens that live 10.

- 13. had skin cancers sinct she built her home there. Ahh, when she sent 14.
- 15. her water, drinking vater off to be sampled, the test results never 16.
- 17. came back, so just to be sure, they don't drink the water, but they 18.
- 19. do bathe in it.. her, ahh, 15 year old son has very serious bronchial 20.

- 28. .
- 29. . Texas highway what would be making them go belly-up, what would L30.
- 31. be making-them die? Also, the, ahh, the townspeople were told, 32.
-33. ahh, this was-a very, ahh (pause), well this was a center, ahh
'34, 35.- at one time it was a deer lease.- And they were told as-late as, ahh
~36.
'37. Fall of;1987 that no one could, ahh, you know, lease it for deer 38,

14 . .
" 15 . LOPEZ You know, because of the nature of the, the date, the

18.,
19~. 'FLANAGIN: Yes.

- 21. LOPEZ: You know, I'm, I'm suspecting from what you say that they 22, 23.l are definitely some, ahh, chemicals. Ahh, (pause) to what extent, 24.
- 25. ahn, they may contain radioactivity , I'm not really positive.
26.
- 27. - FLANAGIN: Absolutely. Now, I will tell you for a certainty that

- 29. some other-materials that I have, ahh, done some investigative work

'48.
49.- FLANAGIN: Okay.

51.- LOPEZ: It sounds more like paint, that paint 52.
- 53. FLANAGIN: Absolutely, that's what they call-it paint. But, it's LOPEZ TRANSCRIPT i

- 5. LOPEZ: Yeah, that's what I mean. They use it to, to, ahh, (pause) 6..

'9. FLANAGIN: Right,-to contain the radiation.
10.
- 11. :LOPEZ: Yeah, and, but it, it itself does not-have radiation in it.
- 12. '
- 13. FLANAGIN: Absolutaly. But-if it were stored
- 14 .
-15.--LOPEZ: And, it is'a pretty, ahh, toxic 16.
- 17. FLANAGIN: Right.

.19 . LOPEZ material 2 0. -
.21. FLANAGIN - Right.
22.
23.' LOPEZ: as.I understand it.

- 25. .FLANAGIN - But, if it were-stored with some, ahh, say "nucient fuel" l 26,
- 27. (pause)
-28. -
- 29. LOPEZ: Yeah.
- 30.
- 31. LFLANAGIN: It could possibly become contaminated, could it not?
32.
-33. -LOPEZ:. Well, they, the thing is that, ahh, Comanche : Peak, ahh, 34.
-3 5. - started producing the radioactive vaste when they, when they came -
L36,

138.
139.: FLAltAGIN: Right, surp-you know that's what 40.
41.- LOPEZ: [ conversation unintelligible) 42.
- 43. - FLANAGIN: I believed too, but, ahh, now I found out-that, ahh,

10.
- 11. LOPEZ: Nc.
12.
- 13. FLANAG,IN: You-know, could that possibly be what happened?
14.
- 15. LOPEZ No,-I don't think 16.
( 17 . FLANAGIN: Uhuh.

- 19. LOPEZ: I don't think so, 20.

- 23. LOPEZ: because we've been monitoring, ahh 24.
-25. FLANAGIN: Well, I will tell you this
- 26'.
- 27. LOPEZ: [ conversation, but unintelligible)
"28. .
- 29. FLANAGIN - with a certainty. I am married to a 35 year old man who
.30.
31, is dying and he was a nuclear coating, he was a painter at Comanche 32.
- 33. Peak.
34.
35,. LOPEZ: Uhuh.
36.
.37. FLANAGIN: and he was exposed to radiation at Comanche Peak.
3 8'.
- 39. LOPEZ: I see. ,
40,
- 41. FLANAGIN: and he worked there for less than 2 years with a 1 year
- 42. -
- 43. period off in between. And, he has hemolysis, which is a breakdown
- 44. '
- 45. of the blood cells which is caused by radiation. (pause) And he
-46.
47.- vorked in radiation areas without being cautioned about it. Areas 48.
- 49. Where he had to sign into the plant,. sign in and out of little rooms.
-50.
- 51. And, he was not given a personal radiation detection device. So if
, 52.
I 5 3 '. there was not radiation at the plant in some type, form or fashion LOPEZ TRANSCRIPTION 1
- 1. FLANAGIN: (continued) in 1984 and 1985, why did people wear radiation 2.

, detection devices? (pause) 14.
- 5. LOPEZ: The,-the only 6.
7, FLANAGIN: And, why did gay-husband have hemolysis?
8.
- 9. -LOPEZ: _ I,-I really think that 10.
- 11. FLANAGIN: And why is he dying for no good reason?
12.
- 13. LOPEZ,3 It appears'that those, aht. . that paint has.a lot of very 14.
- 15. toxic materials (TAPE RUNS OUT__ AT THIS POINT - VERY LITTLE FURTHER CONVERSATION)
