ORDER July 24, 1980 The NRC staff has moved for an extension of ~ the time for the filing of exceptions to the Licensing Board's July 11, 1980 initial decision in this proceeding involving modifications to the Trojan facility's control building.

LBP-80-20, 12 NRC The motion represents that the staff has just filed a motion with the Licensing Board seeking clarification of a license condition imposed in that decision.

The staff wishes to defer its determination as to whether to file exceptions until after the Licensing Board has ruled on the clarification motion.

Accordingly, it asks that the time for the filing of exceptions be extended to the 10th day following the date of s.ervice upon it of that ruling.

. We are told by the staff that the time for filing exceptions now expires.today, July 24.

In that circumstance, its extension motion was due in our hands no later than yesterday.

See Appendix A to 10 CFR Part 2, Section IX(d) (3).

Instead, the staff simply deposited the motion in the Com-mission's internal mail system yesterday, with the consequence that it did not reach us until late this morning.

Notwithstanding the tardiness of the motion, we arant the sought extension (which shall apply to all other parties as well).

The Executive Legal Director is requested, however, to remind his staff of the necessity for future full compliance with the Appendix requirement which seemingly was overlooked in this instance.

It is so ORDERED.
