ORDER September 15, 1980 The State of Oregon filed exceptions to the Licensing Board's July 11, 1980 initial decision in this proceeding involving modi-fications to the Trojan facility's control building.

LBP-80-20, 12 NRC On July 28, 1980, we tolled the period for the filing of Oregon's brief in support of those exceptions to await the Li-censing Board's ruling on the State's pending motion for recon-sideration of the July 11 decision.

Our order went on to provide that, within 10 days following. service of the ruling, Oregon was to (1) withdraw its exceptions; (2) amend them in light of the content of the ruling; o_r (3) notify us in writing that it intends to proceed with its appeal on the basis of the exceptions as now formulated.

v on the parties the following day, through inadvertence a copy was not sent to Oregon's lead counsel, Frank W. Ostrander, Jr.

Mr.'Ostrander just recently learned of the entry of the order and has advised us that he will promptly endeavor to obtain a copy of it from applicants' counsel in Porticnd.

In the circumstances, the time for Oregon's notification resoecting its exceptions is_hereby extended to and including September 29, 1980.

In the event that Oregon does not elect

to withdraw the exceptions, the time provided by 10 CFR 2.762(a) i j

for briefing them (as possibly amended) will begin to run on the date of the notification.
