RELIEF FROM THE REQUIREMEt1TS OF THE ASME dOILER AND PRESSURE VESSEL CODE, SECTION XI - DAVIS BESSE NUCLEAR POWER STATI0ti, UtlIT I By letter dated November 22, 1977 you submitted a description of your proposed inservice testing program for pumps and valves for Davis Besse Unit 1 and a request for relief from certain requirements of Section XI of the ASME Code.

We have not completed our detailed review of your submittal.

However, based on our preliminary review, we agree with your determination that it is impractical within the limitat. ions of design, geometry and materials of construction of components for you to meet cartain of the specified ASME Code requirements.

Imposition of those requirements would, in our view, result in hardships or unusual difficulties without a compensatirg increase in the level of quality or safety.

Therefore, pursuant to 10 CFR 50.55a(g)(6)(i), we grant, pending campletion of our detailed review, the relief that you have requested from pump and valve inservice testing requirements of the ASME Code.

Therefore, you are authorized, and should proceed, to implement your proposed program for inservice testing of pumps and valves. When our detailed review of your submittal of November 22, 1977 is complete, we wili (1) issue final approval or your program, which may contain modifications resulting from the staff's review; (2) grant relief from any ASME Code requirements that are determined to be impractical for your facility for the duration of the inspection interval and (3) issue appropriate changes to your technical specifications.

We have determined that the granting of this relief does not involve a significar.t increase in the probability or consequences of accidents

' previously considered nor a decrease in safety margins and thus does not involve a significant hazards consideration.

Roe OCT 191978 Furthermore, we have determined that the granting of this relief from ASME Code requirements does not authorize a change in ef fluent types or total amounts nor an increase in power level. Therefore, we have concluded that the granting of this relief is insignificant from the standpoint of environmental impact and pursuant to 10 CFR 51.5(d)(4) that an environmental statement, or negative declaration and environ-mental impact appraisal, need not be prepared in connection with this action.

A copy of tne Federal Register Notice related to this action is enclosed.
