SUBJECT:

RELIEF FRC!1 THE REQUIREMENTS OF THE ASME BOILER AND PRESSURE VESSEL CODE, SECTION XI - DAVIS BESSE NUCLEAR POWER STATION, UNIT 1 By letter dated October 19, 1978, we provided relief from certain requirements of the ASME Boiler and Pressure Vessel Code,Section XI for the Davis Besse Nuclear Power Station, Unit 1.

Since that letter did nct reference the correct Toledo Edison Company correspondence and failed to include all the relief from those ASMd requirements which were determined to be impractical for your facility, we consider it necessary to restate the specific relief which is granted herewith.

By letter dated June 27, 1977 supplemented by letter dated November 22, 1977, you submitted a proposed inservice inspection and testing program for Davis Besse Unit I and requests for relief from certain requirements of Section XI of the ASME Code.

We have not completed our detailed review of your submittal. However, based on our preliminary review, we agree with your determination that it is impractical within the limitations of design, geometry and materiais of contruction of components for you to meet certain of the specified ASME Code requirements.

Imposition of those requirements would, in our view, result in hardships or unusual difficulties without a compensating increase in the level of quality or safety. Therefore, pursuant to 10 CFR S0.55a(g)(6)(i), we grant, pending completion of our detailed review, the relief that you have requested from certain inser-vice inspection and testing requirements of the ASME Code. Therefore, you are authorized, and should proceed, to implement your proposed program for inservice inspection and testing. When our detailed review of your submittals of June 27 and November 22, 1977 is complete, we will (1) issue final approval of your program, which may contain modifications resulting from the staff's review; (2) grant relief from any ASME Code requirements that are determined to be impractical for your facility for the duration of the inspection interval; and (3) issue appropriate 7 90116 0 3ick

We have determined that the granting of this relief does not involve a significant increase in the probability or consequences of accidents previcusly considered nor a decrease in safety margins and thus does not involve a significant hazards consideration.

Furthermore, we have determined that the granting of this relief from ASME Code requirements does not authorize a change in effluent types or total amounts nor an increase in power level. Therefore, we have concluded that the granting of this relief is insignificant from the standpoint of environmental impact and pursuant to 10 CFR Sl.5(d)(4) that an environmental statement, or negative declaration and environ-mental impact appraisal, need not be prepared in connection with this action.
