CHANGE IN DETERMINATION FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (EPID NO. L-2018-RNW-0002)

Dear Mr. Nazar:

By letter dated May 17, 2017, Florida Power & Light Company (FPL) informed the U.S. Nuclear Regulatory Commission (NRC or staff) of its notice of intent to submit a subsequent license renewal application for Renewed Operating License Nos. DPR-31 and DPR-41 for the Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point). The notice of intent included information to be withheld in accordance with Title 10 of the Code of Federal Regulation (10 CFR) Section 2.390, Public inspections, exemptions, requests for withholding, which required the U.S. Nuclear Regulatory Commission (NRC) staff to conduct a proprietary review.

By letter dated May 25, 2017 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML17139D441), the staff issued a public version of its proprietary determination associated with FPLs notice of intent and determined that the name of the utility, the name of the site, and the name of the state would be withheld as proprietary information pending further notification.

As a result of the staffs proprietary determination regarding FPLs notice of intent, between May 17, 2017, and January 30, 2018, the NRC held several closed meetings and teleconferences with FPL staff to allow the NRC to gain an understanding of specific issues to be addressed in the Turkey Point subsequent license renewal application.

By letter dated January 30, 2018, (ADAMS Package Accession No. ML18037A812), FPL submitted its application for subsequent license renewal of Turkey Point Unit Nos. 3 and 4 to the NRC for review under 10 CFR Part 54, Requirements for renewal of operating licenses for nuclear power plants. Upon submittal of the subsequent license renewal application on January 30, 2018, the basis for withholding the information in the notice of intent (the name of the utility, the name of the site, and the name of the state), as well as the summaries of the aforementioned closed meetings and teleconferences, from public inspection changed such that the information could be made available for public inspection. Therefore, the NRC is now making these documents publicly available.
