Dear Mr. Vassallo:

The Commission recently published its final rule amending Section IV, Paragraph F of 10CFR50 Appendix E in the July 6, 1984 Federal Register (49 FR 27733) relating to emergency preparedness exercises. This final rule provides schedular relief to local governments from annual to biennial full participation in exercises.

Niagara Mohawk and the'New York Power Authority believe that Oswego County need only fully participate in either a Nine Mile Point Nuclear Station or a James A. FitzPatrick Nuclear Power Plant emergency preparedness exercise biennially. This position is consistent with the 'cited new regulation and reasonable in that the facilities and emergency plans are similar and the plants are physically adjacent.

Full participation exercises with Oswego County will be biennially alternated between Nine Mile Point Nuclear Station and the James A. FitzPatrick Nuclear Power Plant, so that each licensee will hold a full participation emergency preparedness exercise with Oswego County once every four years. Otherwise, Oswego County would be required to support an annual full scale exercise. A similar practice, described in our letter dated May 20, 1981 to the Director of Nuclear Reactor Regulation (see attachment), has been accepted by the Nuclear Regulatory Commission.

Currently, the licensee that does not conduct the full participation emergency preparedness exercise with Oswego County conducts a partial participatio'n exercise with the County and other off-site agencies, where specified aspects of the emergency plan are tested'. This practice will continue under the new regulation. Morever, Niagara Mohawk Power Corporation and the New York Power Authority will honor the requests from New York State or Oswego County to fully partici pate in annual exercises, if such requests are made.
