Dear Sir:

This application for an amendment to the James A. FitzPatrick Technical Specifications deletes the reference to Regulatory Guide 1.129 in Surveillance Requirements 4.9.E, " Station Batteries," and 4.9.F, "LPCI MOV Independent Power supplies." These changes revise the Technical Specifications in accordance with the Authority's commitment in response to an SSFI team concem (Reference 1, item 4.7.3).

The changes make the battery technical specifications consistent with actual plant practice and IEEE 4501987 by allowing the application of an equalizing charge to the batteries prior to conducting the performance discharge (capacity) test.

l Enclosed for filing is the signed original of a document entitled " Application for l Amendment to Operating Ucense," with Attachments I and ll thereto, comprising a l statement of the proposed changes to the Technical Specifications and the associated l Safety Evaluation.

In accordance with 10 CFR 50.91, a copy of this application and the associated attachments are being provided to the designated New York State official.
