Commonwealth Edison Company Dresden Nuclear Power Station Unit 2 & 3 NOTICE OF VIOLATION Docket No. 50-237; *50-249 License No. DPR-19; DPR-25 During an NRC inspection conducted March 29 through April 30, 1993, a violation of NRC requirements was identified.
In accordance with the "General Statement of Policy arid Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:
10 CFR 50.55a(f)(4) states components that are classified as ASME Code, Class 3 must meet the inservice test (IST) requirements set forth in Section XI of the ASME Boiler and Pressure Vessel Code.
ASME Section XI, IWV-3415 requires valves with a fail safe function be tested on a quarterly basis.
ASME Section XI, IWV-3522 requires check valves to be exercised on a quarterly basis to the position required to fulfill their safety function.
. Contrary to the above,. the following ASME Code, Class 3 valves were included in the IST program, but not tested in accordance with the Code requirements:
- a.
Control room HVAC valve 2/3-5741-062, which fails open on the loss of instrument air, was not fail safe tested quarterly since July 12, 1989 (50-237/93008-2a(DRS); 50-249/93008-02a(DRS)).
- b.
Contol room HVAC check valve 2/3-1599-103 (designated as 2/3-3899-200 in the IST program) was not exercised to its required open position on a quarterly basis since May 6, 1988 (50-237/93008-02b(DRS);
50-249/93008-02b(DRS)).
This is a Severity Level IV violation (Supplement I.D.3).
Pursuant to the provisions of 10 CFR 2.201, Commonwealth Edison Company is hereby required to submit a written statement or explanation to the U. S.
Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, D.C.
c0555 with a copy to the U.S. Nuclear Regulatory Commission, Region III, 799
- Roosevelt Road, Glen Ellyn, Illinois, 60137, and a copy to the NRC Resident Inspector at the Dresden Nuclear Power Station, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violation, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or a demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
