Acceptance Review of Entergy's Request to Extend Orders (TAC Nos. ME2515-ME2522)
Dear Mr. England:
The Nuclear Regulatory Commissions (NRCs) Orders dated July 28, 2008, consented to the indirect transfer of control of the licenses of Pilgrim Nuclear Power Station, Indian Point Nuclear Generating Unit Nos. 1, 2, and 3, James A. FitzPatrick Nuclear Power Plant, Vermont Yankee Nuclear Power Station, Palisades Nuclear Plant, and Big Rock Point pursuant to Section 50.80 of Title 10 of the Code of Federal Regulations in connection with a proposed corporate restructuring and the establishment of Enexus Energy Corporation. By Order dated July 24, 2009, the effectiveness of these Orders was extended through January 28, 2010. By letter dated November 3, 2009, Entergy Nuclear Operations, Inc., acting on behalf of itself and Entergy Nuclear Palisades, LLC, Entergy Nuclear FitzPatrick, LLC, Entergy Nuclear Indian Point 2, LLC, Entergy Nuclear Indian Point 3, LLC, Entergy Nuclear Generation Company, and Entergy Nuclear Vermont Yankee, LLC, requested a further extension of the effectiveness of these Orders through August 1, 2010. The purpose of this letter is to provide the results of the NRC staff=s acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plants.
The NRC staff has reviewed your application and concludes that it provides technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposal in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
