NRC Response to Updates to the Proposed Amended IP2 Master Trust Date: Wednesday, November 9, 2022 1:37:00 PM

Dear Jean Fleming:

By letter dated August 10, 2022 (ADAMS Accession No. ML22222A087), Holtec Decommissioning International, LLC (HDI) provided notification to the NRC of its Amended and Restated Holtec Indian Point 2, LLC Master Decommissioning Trust Agreement for Indian Point Nuclear Generating Units 1 and 2 (Proposed Amended IP2 Master Trust).

After its initial review of the Proposed Amended IP2 Master Trust, the NRC staff objected to the Proposed Amended IP2 Master Trust going into effect in an email dated September 22, 2022 (ADAMS Accession No. ML22269A345). Subsequently, the NRC staff requested additional information to determine whether the document complies with applicable regulations in a letter dated October 21, 2022 (ADAMS Accession No. ML22292A238).

By letter dated November 4, 2022 (ADAMS Accession No. ML22308A257), HDI provided additional information and proposed updates to the Proposed Amended IP2 Master Trust to address the NRC staffs concerns. Specifically, Section 3.07(a) of the Proposed Amended IP2 Master Trust was updated to ensure consistency with 10 CFR 50.75(h)(1)(ii).

The NRC staff has reviewed your responses and proposed revisions to the Proposed Amended IP2 Master Trust and finds that they address the concerns stated in the NRC staffs objection email and subsequent information request. Therefore, the NRC staff does not object to the November 4, 2022, Proposed Amended IP2 Master Trust, and that document may go into effect immediately at the discretion of HDI.
