Bob, By letter dated April 15, 2019 (ADAMS Accession No. ML19105B241), Entergy Nuclear Operations, Inc. submitted a license amendment request (LAR) for Indian Point Unit No. 2 (IP2) to revise the IP2 Operating License (OL) and revise the Technical Specifications (TSs) in Appendix A to Permanently Defueled Technical Specifications (PDTS), the Environmental Technical Specification Requirements in Appendix B of the OL, and the Inter-Unit Transfer Technical Specifications in Appendix C. The proposed changes would revise certain requirements contained within the IP2 OL and the Appendices A through C TSs and remove the requirements that would no longer be applicable after IP2 is permanently shut down and defueled.

The purpose of this e-mail is to provide the results of the Nuclear Regulatory Commission (NRC) staffs acceptance review of this PDTS LAR. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it provides technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staffs detailed technical review by separate correspondence.

Based on the information provided in your submittal, the NRC staff has estimated that this licensing request will take approximately 700 hours29.167 days <br />4.167 weeks <br />0.959 months <br /> to complete. The NRC staff expects to complete this review in approximately 12 months from the date of this e-mail communication. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date (greater than a month) or significant changes in the forecasted hours (greater than 25%), the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager. These estimates are based on the NRC staffs initial review of the application and they could change, due to several factors including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities. Additional delay may occur if the submittal is provided to the NRC in advance or in parallel with industry program initiatives or pilot applications.

The staff also notes that the Entergy LAR dated December 11, 2017 (ADAMS Accession No. ML17354A007) is currently under review. The review and approval of the subject PDTS LAR is contingent upon the outcome of the NRC staffs review of the December 2017 LAR. This would constitute as a linked requested licensing action (RLA) per NRR Office Instruction, LIC-109, and therefore, would normally be deemed as not acceptable.

However, based in part, on the staffs current evaluation and extent of completion of the December 2017 LAR, the acceptance of the PDTS LAR has been deemed by the NRC staff as an appropriate action. In addition to the various factors indicated above, additional delay may occur if there are unanticipated changes submitted by the licensee to the linked RLAs.
