Mahvash, This message is to confirm that the NRC staff has revised its expected completion for the subject licensing action as applicable to Indian Point Unit 2 to no later than September 2020 (or approximately 12 months from the date of the acceptance e-mail shown below).

This timing is consistent with the IPEC licensing action need date as provided in your March 26, 2020, message (attached). Please consider 9/30/2020 as our updated estimated completion date, superseding the original July 2020 target date as communicated in my original September 24, 2019, e-mail message.

There is no intended change to the staffs total forecasted review hours (50 hours5.787037e-4 days <br />0.0139 hours <br />8.267196e-5 weeks <br />1.9025e-5 months <br />), nor in the target date for completion of the respective review for Indian Point Unit 3 (IP3) (i.e., July 2020 to coincide with the expected receipt of the associated 10 CFR 50.82(a)(i) and (ii) certifications for IP3).

Mirzai, By letter dated July 30, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19232A070), Entergy Nuclear Operations, Inc. (the licensee) requested rescission of Interim Compensatory Measure 8.1 of Order EA-02-026, Issuance of Order for Interim Safeguards and Security Compensatory Measures for Indian Point

Nuclear Generating Stations, Unit Nos. 2 and 3, (ADAMS Accession No. ML020500410).

The purpose of this e-mail is to provide the results of the NRC staffs acceptance review of this licensing request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review for this licensing action. The acceptance review is also intended to identify whether the request has any readily apparent information insufficiencies in the characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your licensing request and concluded that it provides technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the request in terms of protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staffs detailed technical review by separate correspondence.

In the submittal, the licensee requested rescission of the Order such that the rescissions would become effective following its submittal of the certifications required by 10 CFR 50.82(a)(1)((i) and (ii). The NRC staff understands that the licensee plans to submit the certifications approximately in May 2020 and May 2021 for Indian Point, Unit Nos. 2 and 3 (IP2 and IP3), respectively.

Based on the information provided in your submittal, the NRC staff has estimated that this licensing request will take approximately 50 hours5.787037e-4 days <br />0.0139 hours <br />8.267196e-5 weeks <br />1.9025e-5 months <br /> to complete. The NRC staff expects to complete its review in approximately 10 months and 22 months, from the date of this e-mail communication for IP2 and IP3, respectively, to coincide with the expected receipt of the licensees required certifications. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date (greater than a month) or significant changes in the forecasted hours (greater than 25%), the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager. These estimates are based on the NRC staffs initial review of the application and they could change, due to several factors including requests for additional information, and unanticipated addition of scope to the review. Additional delay may occur if the submittal is provided to the NRC in advance or in parallel with industry program initiatives or pilot applications.
