Dear Mr. Smith:

l Pursuant to FPM Bulletin 842-3, I have officially detemined that Agency law  !

enforcement. positions.in the NRC Office of the Inspector General (0!G) are  ;

either rigorous positions or secondary positions, as those phrases are defined in.5 CFR Part 842 Subpart H. The special retirement provisions of the Federal Employees Retirement System (FERS) would apply accordingly. (

In the enclosed letter dated June 21, 1988, former Chairman Zech provided FERS

' coverage for positions in the NRC Office of Investigations (01) and the NRC 1 Office of Inspector.and Auditor (OIA). The OIG was established by statute in i April 1989 and OIA was abolished. The CIA positions listed in Chairman Zech's i letter are no longer current and the new OIG positions created by.this  :

organizational change, but not previously covered under the special FERS '

retirement provisions of Title V, U.S. Code, Section 8412 (d), are now covered. Additionally, I have detemined that one new position in 0! meets 4

the definition of secondary position under the regulations. Therefore, this position is also eligible for the special FERS retirement provisions applicable to law enforcement officers.

2 As required, below is a list of the Agency's rigorous and secondary law enforcement positions in the OIG and 01 and the number of present incumbents.
