Dear'Mr. Shapiro:
The Inspector General Act Amendment of 1988 established a statutory Office of Inspector General (OIG) within the Nuclear Regulatory Commission, effective Ar.ril 17, 1989. This Office is responsible for providing ,
leadership and recommending policy for investigative activities designed to '
promote economy and efficiency in the administration of, and to prevent and detect fraud, abuse or criminal activity in Commission programs and operations. Specifically, the Office is vested with the authority to recommend action to the Commission in regard to findings resulting from criminal investigations conducted by OIG.
Prior to the establishment of the OIG, the Office of Inspector and Auditor (OIA) existed and included the positions of: Criminal Investigator, GG-1811, at the GG-9 through 14 levels. These positions were granted general .
retirement coverage under the provisions of 4 U.S.C. 8336(c) in May and l June, 1987. Copies of the OPM approval letters for these positions have I been attached. These positions now exist in the OIG and reflect the same l criminal investigation duties that existed in OIA. The only change that is i reflected is that of the organization. Therefore, we request that OPM l approval for general retirement coverage for these positions under the provisions of 5 U.S.C. 8336(c) be granted.

REGULAR DUTIES
- 1. Conducts investigations of possible violations of criminal laws or i
regulations and other irregularities in the administration of Comission programs and activities. ,
- 2. Analyzes and sumarizes the results of investigations undertaken and i documents them in accordance with professional standards. '
- 3. Assists, as required, in inspections of activities within the Comission.
4 Assists in the development and implementation of the Comission's investi-gative policies and procedures.

Knowledge of the Atomic Energy Act of 1954, the Energy Reorganization Act of 1974, and statutes relating to Equal Employment Opportunity sufficient to perform investigations into violations as they relate to these laws.
Experience in the case preparation and presentation of evidence for use in Federal criminal prosecutions involving complex fact matters.
Experience and ability to plan and conduct complex and sensitive investiga-tions, interviews, and write clear, concise and accurate witness statements and investigative and inspection reports. This also applie,s to proactive investigators.
Ability to establish and maintain effective working relationsnips with NRC personnel, private incustry, law enforcement personnel, Congressional personnel, GAO and other personnel.
