l The purpose of this'1etter is to appe51 the Office of Personnel Management's (OPM) decision to d(ny coverage under 5 IfSC 8336(c)(1) for the position of Criminal Investigator, 'GG-1811-12; (pd #C998), in the Office of Inspector ~

a6fAndterT(OIA).~e OP" denied coverage because the incumbent does not spend at least 50 percent l of the time managing or conducting criminal investigations. According to OPM, l if an employee spends an average of at least 50 percent of time perfoming a  !

duty or group of duties, those are considered his or her " primary duties".  !

l Our decision to include this position under the 6(c) provision is based on OPM's l widely accepted classification practice which states that a duty occupying 25 percent of the employee's time is considered substantial and .orade and series I controlling. (CSC Personnel Management Series #16, June 1063.) . As stated in l - our previous memorandum dated February 2,1987, approximately 40 percent of the incumbent's time is spent managing or conducting criminal investigations and 60 percent of the incumbent's time is spent investicating other irregularities and inspecting activities in the administration of Co-rtission prograns. Based on this practice, we believe 40 percent is substantial enough to neet the "prinary duties" definition.

l Our decision is also based on CIA's need to establish a criminal investigative conponent within the Office to conduct investiaations, inspections, and evaluations to ensure the intenrity and effectiveness of all PRC operations and to deternine whether crininal violations have occurred.
