4 RE: CCN:EK: cat Enclosed are three position descriptions: 1) Assistant to the Director, Office of Investigations (OI), GG-1811-15; ?) Airector. 01 Field Office, GG-1811-15; and 3) Investigator, -GG-1811-12, Office of Inspector and Auditor (OIA).
The first position was approved by OPM for general coverage under 6(c) retirement on May.17, 1984. When the position was submitted, however, it was titled Policy & Special Projects Assistant (Senior Investigator)
GG-1811-15. There has been no change in the duties and responsibilities.
We ask only that you annotate your records to reflect the current title which is: Assistant to the Director, OI.
Positions two and three have not been submitted to OPM at the GG-15 and GG-12 grade levels; therefore, we request that you review these positions and confirm general coverage under the 6(c) provision. Both positions require law enforcement experience as a basic qualification. It should also be noted that both the Director, OI Field Office, and the Investigator, OIA, were approved by OPM on May 17,1984, for 6(c) coverage at grades 14 and 13 respectively.

This responds to your memorandum dated September 10, 1985, requesting additional information for several of our law enforcenent positions in the Of.fice of Inspection & Enforcement (IE).
v As you know, the Office of Personnel Management (OPM) has already approved our 1811 series investigator positions in the Office of Investigations (01), for 6(c) retirenent. These positions are the direct successors of those from IE.
However, we understand that before a detemination can be made for general coverage under 5 USC 8336(c) (1) for the positions in IE, you need the following information.
I Question 1 For the positions listed below, what percentage of time do the incumbents spend on conducting investigations of violations of.the criminal codes of the United States't

All of the incumbents' time is spent on these types of investigations. Forty to 50% of this time is spent in the field. The remainder of time is spent preparing testinony, assisting grand juries, writino reports, liaison with other Federal Enforcemer.t agencies, etc. These duties are perfomed in nomal office conditions.
Ouestion 2 1.' hat criminal codes have been violated?
Answer i Generally, knowing and willful violations of t'PC reculations which implement the HnC-applicable portions of the Atomic Energy Act (as well as other Federal statutes) are defined as crimes and are legally construed as viola-tions of the Atomic Energy Act. The evidence gathered by IE investigators may establish willful violations of various sections of the Federal crininal code such as: false statenents (18 USC 1001), conspiracy (18 USC 371), mail fraud (28 USC 1341 or 1343) or related offenses. The IE investigation of these matters in addition to supporting NRC civil enforcenent actions are referred to the "enartment of Justice for criminal prosecution.

Answer 4 Yes. Prior experience as a basic law enforcenent officer is a prerequisite for all the positions.
