COVERAGE OF INVESTIGATORS AND SUPERVISORS FOR PURPOSES OF RETIREMENT UNDER 5 USC 8336(c)

During the recent weeks my supervisor and I have discussed each of our '

Agency's file regarding the special retirement provisions for law enforcement officers.

Enclosed is material which will assist you in updating the files. We request that you review this information and reconfirm the Office of Personnel

Management's (OPM) concurrence in covering our investigators in the 1811 l series as outlined in Manual Chapter 831-1, $9-3.

%e first enclosure contains position descriptions-from the Office of Inspector,a andAuditor,(0!A). DIA retains responsibility for the investigation of criminal

' violations by MRC employees and contractors, e.g., Fraud Against the Government, Conspiracy, Theft of Government Property, Conflict.s of Interest, Bribery, etc.,

as originally outlined in the agency submission to the Civil Service Comission 3 on February 12, 1975. While these position descriptions were approved, we would i appreciate a reconfirmation from OPM to that our files will be administratively j complete. /

The secedsp contains a cover memorandum and the position descriptions which are in effect for the incumbents in the Office of Investigations, (01).

OI investigations primarily involve alleged or suspected violations of Federal l laws and/or NRC regulations, including those made criminal by statute. The  ;

positions descriptions in this Office are the direct successors of the position descriptions in the Office of Inspection and Enforcement. On November 4,1979, the Acting Chief of OPMs Benefits Policy Staff, Mr. Kenneth H. Glass, replied to the NRC in writing. His letter advised that the investigator position wascoveredunder5USC8336(c). Again, we are asking that you provide the necessary review and concurrence so that both files are complete.
