Dear Ms. Kirwan:

i In our. memorandum of December 29, 1983, we asked you to reconfirm an earlier l decision made by the Civil Service Commission (CSC) on February 12, 1975.  ;

. As you know, at that time the CSC approved coverage for our investigator j positions in the Office of Inspector and Auditor (OIA) under 5 USC 8336(c).  !

4 Late January 1984, you. verbally reconfirmed this decision; however, you l questioned whether two of the positions, the Director, DIA, and the l Assistant Director for Investigations. 014 were sent with the original  !

request for coverage under 5 USC 8336(c). ,

We believe that all the investigator position descriptions, supervisorj and nonsupervisory, and including those positions, were sent from the Office of Inspector and Auditor to the Civil Service Commission in 1975.

Therefore, we request that you review the attached two position descriptions in question, and reconfire CSC's decision to cover them under.5 USC 8336(c).

PURPOSE OF POSITION ,,

  • The Office of Inspector and Auditor serves as the audit inspector and investigative arm of the Commission and on its evaluation and review of integrity of operation.

The Director provides the overall planning, management, and leadership for OIA activities which include the following:

i

1) long-range comprehensive management audit programming l covering all phases of NRC operations, developing policies l and standards relating thereto, and issuing reports with l recommendations to the Commission and key management;
2) conducting investigations, inspections, and evaluations to to assure the integrity and effectiveness of all NRC' operations and to determine whether criminal violations have occufed for referral to the Justice Department or other law enforcement agencies;
3) monitoring and following-up on actions taken by agency management in response to findings and recommendations to assure the Chai.rman that appropriate corrective action is taken;
4) acting for the Commission under the "Open-Door" policy to assure the free flow of internal information to the Commission by hearing cmployee concerns alleging misconduct, mismanagement or wrongdoing; evaluating the facts, reporting findings and making recommendations to the Commission;
5) conferring with and testifying before Congressional Committees on matters that have been investigated, inspected, or audited and which have come within the public's and the media's purview;
6) maintaining continuing liaison with the GA0 by coordinating NRC comments on its reports of audits and in scoping its audits at their initiation; and
7) maintaining liaison with such other government agencies as OMB, Treasury Department, FBI, State and local investigative authorities.

Knowledge of Federal, State and local criminal laws; law enforcement practices, procedures and rules of evidence; and interview'and

Knowledge of financial and management audit techniques used .in both public and private sectors including contracting principles for use in conducting financial management audits within NRC.

Knowledge of the Atomic Energy Act of 1954, as amended, and the Energy Reorganization Act of 1974.

Knowledge of the Freedom of Information Act and the Privacy Act.

A general knowledge of laws relating to Federal funds and property, comptroller General decisions and regulations of the Office of Manage-ment and Budget Treasury Department and General Accounting Office.

Knowledge of personnel policy, practices, administration, and procedures in the Federal government and NRC.

Directs, supervises and coordinates the activities of the Office of Inspector and Auditor.

Deals directly with the Chairman, Commissioners, and the ' fiscal policy staffs 'of the Treasury Department, GA0 and other Federal agencies relating to management on financial audits of NRC.

Deals directly with the Department of Justice, FBI and other governmental

./ investigative agencies on criminal matters of OIA investigations / inspections and audits. ,

Frequent contacts with Directors of Program Offices and Division Directors, top management, officials in the private sector as well as in Government concerning matters disclosed by Audits and Inspections.

Frequent contacts with Congressional comittees, either as a testifying witness or with comittee staffs having an interest in an incident under investigation by OIA.

COMMITMENTS Establishes and authorizes policies and standards governing the Comission's financial and management audit program.

Initiates investigations as necessary into specific incidents or repeated occurrences which seem to warrant such investigation.

Recommends action to the Commission in regard to the findings resulting from financial and management audits conducted by the Office of Inspector and Auditor.

Establishes methods of responding to General Accounting Office requests for information.

Establishes procedures for administering the day-to-day audit activities j of NRC.  !

FUNCTIONAL STATEMENT

The Assistant Director for Investigations assists the Director in providing -

the overall planning, management and leadership for investigations and s some inspections and audits assigned to the Office of Inspector and ~ '

Auditor (0IA).

REGULAR DUTIES .

/ Assists in the development and implementat i on of the Comission's investigative and inspection policies and procedures. .

-Plans and supervises investigations an d reviews draft reports for final processing of possible violations of criminal laws or regulations and other irregularities in the administration of Comission programs and activities.

Analyzes and summarizes those investigations undertaken ans assures that they are pursued, documented and finalized in accordance with profe'ssional ~

standards. . ,

Participates in and, as appropriate, coordinates and supervises audit and inspection activities in those areas more susceptible to pos:ible

- misconduct, i.e., grants, research, conflicts of interests, etc.

Assures the Director that investigations and inspections are pursued, '

documented and finalized in accordance with professional standards and with due regard to applicable laws and regulations and the rights of individuals.

- Maintains liaison with key Government personnel in other departments and agencies, i.e., Department of Justice (D0J), FBI, Treas.ury Department, Postal Inspection Service, etc.

Perfonns such other specialized duties assigned by the Director.

Provides expert advice to the Director concerning ".he implications and ranifications of investigations proposed or being conducted by OIA.

Occasional contacts with mid-level and top management of private industry as well as other Government agencies in relation to inspections and investigations being conducted by NRC.

Occasional contact with Congressional Committees having an interest in an incident under investigation by OIA. ,

Directs and conducts investigations and inspections relating to the integrity of operations of NRC. Conducts other such investigations as may be required.

Assists in development and implementation of Commission investigative policies and procedures and changes to them.

Recommends Action.to be taken in investigations involving criminal acts or violations of NRC regulations. - -
