SUBJECT:

COVERAGE OF OIA INVESTIGATORS AND SUPERVISOR FOR PURPOSES OF RETIREMENT UNDER 5 USC 8336(c)

It is our understanding that Sue Dickerson, of your office, will be meeting with OPM on Monday next in reference to "6(c) retirement coverage for NRC employees who are investigators. Attached are copies of correspondence between this agency and OPM's predecessor (Civil Service Comission) which show that the Office of Inspector. and Auditor (01A) investigators (GG 13/14, 1811) and supervisory investigator (GG 15,1811) have been covered under the provisions of 5'USC 8336(c) since prior to the fonnal acknowledgement by the Civil Service Comission of that fact on June 21, 1976. Apparently, OPM is unable to find a copy of the attached correspondence.

It should be noted that although the investigation of Atomic Energy Act violations has been transferred to the Office of Investigations (01), this office still has responsibility for the investigation of criminal violations by NF.C employees and contractors, e.g., Fraud Against the Government, Conspiracy, Theft of Government Property, Conflicts of Interest, Bribery, etc., as originally outlined in the agency submission to the Civil Service Cownission on February 12, 1975. Parenthetically, it is noted that all of the current DIA investigators were hired and have paid the appropriate retirement contribution of 71 percent with the understanding and belief that they are covered. A previous 01A investigator, Thomas Hurney, retired under the provision approximately September 1980. Another previous employee, Jerry Strickler, has already received his certification of 20 years "6(c)"

service, which included NRC service, from OPM. Additionally, it is my under-standing that Mr. James Cumings, currently detailed to the ED0's office, is also in a covered "6(c)" position. Upon Mr. Cumings assuming the position of Director, DIA, it was determined by your office that his position was covered and the appropriate 7) percent deduction has been made from his salary to the present time.

Based on the above, it would appear that negotiations with OPM should be limited to discussion of whether 01 investigators and supervisors should be given coverage under 5 USC 8336(c). However, because of the substantial interest of the OIA investigative staff in the continuation of coverage for them, it is requested that you provide a copy of the attached correspondence to the OPM and that a representative of the OIA investigative staff be per-mitted to accompany Ms. Dickerson on Monday - solely for the purpose of protecting the interests of the OIA investigative staff. .I CONTACT: Ronald Smith, OIA 49-27170
