Enclosed are two positions: '(1) Director, Office of Investigations, (OI)

(SES-1811), and the Deputy Director, 01 (SES-1811), which the Agency has determined meet the retirement eligibility provisions of 5 USC 8336(c)(1).

Since these positions have never been submitted to the Office of Personnel Management (OPM) for concurrence, we ask you to review them and advise us in writing of OPM's decision. We believe these positions would f all under the secondary / administrative category.

01 was specifically established as an independent investigative unit within the Nuclear Regulatory Commission to conduct investigations into allegations of " wrongdoing"'by licensees, their contractors, vendors and license applicants, so virtually all 01 investigations involve ostensible criminal violations. Therefore, criminal investigative experience and knowledge are basic qualifications for both positions.

The Director, assisted by the Deputy Director, manage, supervise, and administer the entire investigations program within the purview of the Office. Additionally, all of our primary 1811 investigator positions in 01 have been approved under the 6(c) provision.

As stated, the position descriptions are enclosed for your review and approval.

PURPOSE Of POSITION The Office of Investigations (01) serves as an independent investigative unit within the Nuclear Regulato.ry Comrnission and is responsible for the conduct ,

(c) Maintains liaison with and advises the Commission, the Executive Director for Operations, Regional Administrators, and other Office Directors, as appropriate, of investigations that have safety implications.

(d) Reviews and approves selected investigative reports prepared by the inves-tigative. staff for the purpose of determiriing completeness, sufficiency of evidence and relevancy of material presented.

(e) On occasion may personally supervise and participate in the conduct of _

special investigations of a highly complex and difficult nature involving sensitive situations and requiring the exercise of an extraordinary de-gree of sound judgmerit.

(f) Provides expert counsel to the Director, 01, infulfilling 01 responsi-bility for referring appropriate m6tters to the Department of Justice stemming from investigations by 01 and participates in federal and grand jury investigations. ,,-
