Gentlemen:

SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-302/93-27)

This refers to the inspection conducted by J. J. Lenahan of this office on

November 8 - 12, 1993. The inspection included a review of activities

authorized for your Crystal River facility. At the conclusion of the

inspection, tie findings were discussed with those members of your staff

identified in ?he enclosed report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice).

Violation A lists seven examples of failure to implement the written

requirements of the reactor building tendon surveillance program. This

violation is of concern because the examples listed in the violation show

failure of your personnel to perform adequate oversight of the tendon

surveillance contractor, and failure of the Quality Control (QC) inspector to

properly document and inspect the tendon surveillance activities.

Violation B is of concern because of your misinterpretation of the provisions

of Technical Specification 4.02 issued by Amendment 128 of the Technical

Specifications which permits extending surveillance intervals by 25 percent.

Your attention is invited to the Safety Evaluation Report which supports

Technical Specification Amendment 128, the Bases for Technical Specification 4.02 (Amendment 128), and the guidance provided in NRC Generic letter 89-14

which state that allowance for extending surveillance intervals can not be

used repeatedly merely as operational convenience to extend surveillance

intervals beyond those specified.
