Dear Mr. Cowan:

By letter dated April 12,1999, Florida Power Corporation (FPC) Informed the U.S. Nuclear Regulatory Commission (NRC) staff that the amendment proposed by FPC's application dated October 16,1998, and supplemented December 22,1998, was being withdrawn. The

_ proposed amendment regarded the normal standby position of Decay Heat Removal (DH) system valves DHV-34 ~and DHV-35. The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register fo, publication.

' Prior to receipt of the FPC letter withdrawing this amendment request, the staff had identified that the submittal was deficient in that the measures to ensure that the DH system remained water solid were inadequate and the submittal did not provide verification that the valve timing design basis was adequate to assure the system would perform its safety function. The FPC.

. response to these deficiencies was also inadequate, for the same reasons. FPC is encouraged to ensure that alllicense submittals receive an adequate quality review prior to.
