REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE

Dear Mr. Kelly:

By letter dated May 5,1999, Florida Power Corporation (FPC) subn.itted a license amendment request, which included Babcock & Wilcox Owner's Gmup (B&WOG) Topical Report BAW-2346P, "Altemate Repair Criteria for Tube End Cracking in the Tube-to-Tubesheet Roll Joint of Once-Through Steam Generators," Revision 0, and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. By letter dated May 21,1999, FPC forwarded a nonproprietary version of BAW-2346P for placement in the public document room.

An affidavit dated April 30,1999, executed by yourself for B&W Owners Group, the owner of the information, was included in the application. You stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

.(a)  : The information reveals data or material concoming B&WOG research or development plans or programs of present or potential economic advantage to the B&WOG.

(b) The use of the information by a non-member would decrease his expenditures, in time or resources, in designing, producing or marketing a similar product.

(c) The information consists of test data or other similar data conceming a process, method or component, the app! cation of which results in a economic advantage to the B&WOG.

The U.S. Nuclear Regulatory' Commission (NRC) staff reviewed your affidavit and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements,

have determined that the submitted information sought to be withheld contains trade secrets or propnetary commercial information and should be withheld from public disclosure. '

Therefore, we have determined that the B&WOG Topical Report BAW-2346P, Revision 0, entitled "Altemate Repair Criteria for Tube End Cracking in the Tube-to-Tubesheet Roll Joint of Once-Through Steam Generators," marked as propnetary, will be withheld from public -

disclosure pursue.it to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any nd directlyincomed to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
