Dear Mr. Smith:

Pursuant to FPM Bulletin 842-3, I have officially determined that Agency law enforcement positions in the NRC Office of the Inspector General (0IG) are l

,- ' either rigorous positions or secondary positions, as those phrases are defined i in 5 CFR Part 842 Subpart H. The special retirement provisions of the Federal.

Employees Retirement System (FERS) would apply accordingly.

In the enclosed letter dated June 21, 1988, former Chaiman Zech provided FERS coverage for positions in the NRC Office of Investigations (01) and the NRC Office of Inspector and Auditor (OIA). The OIG was established by statute in April 1989 and CIA was abolished. The OIA positions listed in Chaiman Zech's l

letter are no longer current and the new OIG positions created by this j l organizational change, but not previously covered under the special FERS l l retirement provisions of Title V, U.S. Code, Section 8412 (d), are now covered. Additionally, I have determined that one new position in OI meets .

l the definition of secondary position under the regulations. Therefore, this l l position is also eligible for the special FERS retirement provisions '

applicable to law enforcement officers.
