Contract No. NRC-17-83-399 Since the beginning of the subject contract, on f4 arch 15,1983, Tayloe Associates has failed to make timely deliveries of 23 transcripts to NRC. Thirteen of these late transcript deliveries were for hearings .

held in New York. l On May 2,1983, you requested relief from the one-day delivery allowance for hearings held in locations specified in Article VI, Paragraph 1.g.1 of the contract, which includes New York. Your request for relief in the delivery requirements of the contract in no way relieves you of the.

obligation to fulfill the delivery requireraents stipulated in the contract. J It is .important that these transcripts be delivered on time. Failure to l do so could jeopardize the interests of the Comission and adversely I impact its hearing review process. In addition, we have received several complaints that the copies were not available to the public on time. 1 During our meetings on May 2,1983 and May 12, 1983, you were shown i examples of the poor quality of the transcripts we had received, e.g., j illegible text, blank pages, quadruple spacing on pages, and you indicated i you would take the necessary actions to correct these problems. Recently, the quality of the transcripts has-improved. We expect this improvement -

to continue and further expect that you will exercise the required quality control to ensure that each transcript fully meets the standards  ;

set forth in the contract. '

On March 23, 1983, you requested, and received, verbal pemission to use a subcontractor, Pauline James, not listed in the contract. At that time, and on several occasions since, you were asked to submit the required backgound infomation on this subcontractor and a request that she be added to the list of approved subcontractors in the contract. To date, you have not compiled with this request.

I Your letter of May 14, 1983 lists the subcontractors you have used to perform the work under this contract. Included in the list is Bowers l Reporting Company, San Francisco, CA, with a statement that Bowers is not an approved subcontractor. Your attention is drawn to Article VIII, Paragraph P.2 of the contract which states:

... no contract shall be made by the contractor with any other party for furnti.1..s ?ny of the work or services herein contracted for wit!,out the prion :-itten approval of the Contracting Offic.tr ..."

In the future, subcontrac',or approval shall be obtained from the Contracting Officer prior to contract 7ng with any other party to perform work under this contiact.

Please submit, by June 13, 1983, the required background inforination and request for the addition of Pauline Jemes and Bowers Reporting Company to the list of approved subcontractors in the contract.  !

You are reminded that failure to make timely delivery of transcripts and to abide by the other terms of the contract is a breach of your contract. 1 Your attention is invited to the liabilities that may be involved pursuant l to the " Default" provisions therein. Acceptance by the Government of any delinquent transcripts or services is not to be construed as an intention on the part of the Government to condone any delinquency, or as a waiver of any rights the Government may have under the contract.
