SUMMARY

OF ANNUAL ASSESSMENT MEETING On September 22, 2020, at 6:00 p.m., the U.S. Nuclear Regulatory Commission (NRC) conducted a public webinar to discuss its assessment of the safety performance at Indian Point Units 2 and 3 for 2019; the proposed license transfer of the plant for decommissioning; and the Expert Evaluation teams report on the 42-inch Algonquin Incremental Market (AIM) natural gas pipeline near the plant.

The NRC discussed its assessment of the safety performance for the period of January 1 through December 31, 2019, as documented in our letter dated March 3, 2020 (NRCs Agencywide Documents Access and Management System (ADAMS) Accession Number ML20059M205). ADAMS is accessible from the NRCs website at http://www.nrc.gov/reading-rm/adams.html. This meeting also addressed the commitment to Congresswoman Nita Lowey to hold a public meeting on the Expert Teams findings relating to the AIM gas pipeline, as stated in the April 15, 2020, letter from NRC Chairman Kristine Svinicki (ADAMS Accession Number ML20104C075),

and the proposed license transfer process of Indian Point to Holtec, as stated in the April 16, 2020, letter from Margaret M. Doane, NRC Executive Director for Operations (ADAMS Accession Number ML20092H996).

2 Members of the public, local officials, State officials, and media attended the meeting and were offered the opportunity to question the NRC regarding Entergys performance and the role of the agency in ensuring safe plant operations. A statement on behalf of Senator Chuck Schumer was read during the meeting and is enclosed to this meeting summary.

  • I appreciate the NRC holding this virtual meeting tonight. Senator Schumer wishes he could be here but things are pretty hectic back in Washington right now.
  • But, regardless, the future of Indian Point and its surrounding communities are top of mind and he wanted me to pass on a few of our thoughts.
  • First, the process of decommissioning Indian Point is well underway, and our team is regularly meeting with Entergy, Holtec, and the NRC, making sure we are informed and that community concerns are heard and adhered to.
  • Senator Schumer is a proud cosponsor of the STRANDED ACT.
  • And he continues pushing for transparency and extensive community engagement, and we urge the NRC to use its authority to ensure that decommissioning proceeds with the proper financial assurances that this community so rightly seeks.
  • The Senator will work ceaselessly to ensure that Indian Point is decommissioned safely; the community is not further financially burdened; and that the site is restored to a state that is befitting of our beautiful region.
  • After all, the money used to decommission the plant and restore the site - the decommissioning trust fund - is paid for by ratepayers. Meaning, this community. And it is the NRCs responsibility to oversee the use of these funds. Senator Schumer demands robust and good-faith engagement from the NRC - because the health, safety, environment, and economic well-being of the communities surrounding Indian Point depends on it. This must come before the profits of Holtec, Entergy, or any other company.
  • Because at its core, the NRC is responsible for keeping our communities safe. And the NRCs lack of transparency in the recent gas pipeline scandal has raised serious concern as the NRC reviews Entergy and Holtecs license transfer application.
  • As mentioned, in late February the NRC Inspector General released a report showing that the agency misled the public about the safety of building a massive, high-pressure gas pipeline under Indian Point. Disturbingly, the report found multiple significant problems with how the NRC staff analyzed the safety of siting a new natural gas pipeline underground near Indian Point.
  • Senator Schumer wanted me to reiterate that this is totally unacceptable coming from the agency charged with overseeing the safe, comprehensive, and transparent decommissioning of Indian Point.
  • And the NRC, in conjunction with all relevant stakeholders, needs to reevaluate its process for peer reviews, inspection support, petition reviews, inter-agency work, and pipeline analysis.
  • A similar lack of transparency or failure to ensure the public is properly informed about the decommissioning of Indian Point is wholly unacceptable to Senator Schumer and we will continue to do everything in our power to ensure that the NRC, Entergy, and Holtec are acting with this communitys safety, prosperity, and health in mind.
