APPENDIX A i NOTICE OF VIOLATION Power Authority of the State of New York Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. DPR-59 As a result of the equipment qualification (EQ) inspection of April 27 -

i May 1, 1987, and in accordance with NRC Enforcement Policy (10 CFR 2, Appendix C) the following violations have been identified:

A. 10 CFR 50, Appendix B, Criterion VII states, in part, that: " Documentary ,

evidence that material and equipment conform to procurement requirements shall be available...."

Procurement of Materials and Services Procedure No. EDP-16 requires a technical review of all safety related " Class I" equipment purchase documentation to ensure all required specification information is correct.

Contrary to the above, on April 30, 1987, the verification data for two ,

commercial grade items, Ampere Meter Model No. GE P/N AB-40 and l Mercury Wetted Relay Model No. GE-P/N 225A-5365 - P001 were not available l to demonstrate that a specified critical component characteristic (seismic) had been met in determining the acceptability of the commercial grade items for safety related applications.

This is a Severity Level IV violation. (Supplement I)

B. 10 CFR 50.49 paragraph (f) requires that qualification of each item of  ;

electrical equipment be based on testing or experience with identical '

equipment or with similar equipment with supporting analysis to show that the equipment is acceptable; 10 CFR 50.49, paragraph (g) requires that each item of electrical equipment important to safety be qualified and that qualification must be completed at a time no later than November 30, 1985.

Contrary to the above, on May 1, 1987, the following electrical equipment was identified for which the licensee had not established qualification prior to this inspection.

The installed items include:

1. Brand-Rex cable, EQ Reference File No. 231 (paragraph 10.3)
2. Cerro KXL-760 cable, EQ Reference File No. 205b (paragraph 10.4)

C. 10 CFR 50.49 paragraph (j) requires that a record of qualification be I maintained in an auditable form to permit verification that each item of electrical equipment important to safety is qualified.

Contrary to the above, on May 1, 1986, generic file deficiencies were identified consisting of incomplete, inadequate documentation (e.g. ,- .

missing acceptance criteria, no similarity analysis) to support qualification of electrical equipment within the 10 CFR 50.49 program.

Pursuant to the provisions of 10 CFR 2.201, New York Power Authority is hereby required to submit to this office within thirty days of the date of the letter, which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken.to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
