Appendix a

NOTICE OF VIOLATION

' Commonwealth Edison Company- Docket No. 50-295

~

As a result of the. inspection conducted on April 2, 1985 through April 29, 1985, and in accordance with the General Policy and Procedures for NRC Enforcement Actions (10 CFR Part 2, Appendix C), the following violations were identified:

1. 10 CFR 50.54(m)(1)(iii) states, in part, "...for each fueled nuclear power unit, a licensed operator or senior operator shall be present.at the controls at all times. ,

Contrary to the above, on March 5, 1985 with Unit 1 in cold shutdown (with fuel in the reactor vessel and with greater than ten percent

' shutdown margin) no licensed operator or senior operator was at the controls for a period of approximately one minute. '

This is a Severity Level IV violation (Supplement 1).

2. Technical Specification 3.17.2 states, "1. The aircraft fire detection system shall be operational, or the failed components shall be placed in

the accident mode...[and].. 2. The provisions of Specification 3.0.3 are not applicable to Specification 3.17.2."

Contrary to the above, on March 6,1985 the aircraft fire detection system for the O diesel generator was not operable and'not in the accident ~ mode due to a paper clip holding the reset switch in the

. " reset" position.

This is a Severity Level IV violation (Supplement 1).

With respect to item 2, the inspection showed that action had been taken to correct the identified violation and to prevent recurrence. Consequently, no reply to this violation is required and we have no further questions regarding this matter at this time. With respect to item 1, pursuant to the provisions L of 10 CFR 2.201, you are required to submit to this office within thirty days  ;

of the date of this Notice a written statement or explanation in reply, j including for each item of noncompliance: (" corrective action taken and the results achieved; (2) corrective action to be taken to avoid further l

noncompliance; and-(3) the date when full compliance will-be achieved. .
