Dear Mr. Beard:

This refers to an inspection conducted on August 5-9, 1996, and a subsequent

-- investigation at the Crystal River Nuclear Plant Unit 3. The purpose of the

I inspection and investigation was-to follow up on the fuel handling event which -

occurred on March 26, 1996, in which a fuel assembly was incorrectly

positioned and set on top of another fuel assembly in the core. The'

inspection report, which identified these discrepancies as apparent-

violations, was trans;aitted to you by letter dated August 29, 1996. In

addition, the enclosed investigation synopsis presents the results of the - ,

subsequent investigation. The inspection and investigation findings were

summarized in an exit meeting conducted with your staff by telephone on

February 6, 1997.

Based on the results of this inspection,. the NRC' has determined that

violations of NRC requirements occurred. These violations are cited in the

enclosed Notice of Violation'(Notice), and the circumstances surrounding them

are' described in detail in the referenced inspection report. The violations

are of concern because multiple )rocedural violations defeated the strategy

for preventing fuel handling mislaps. The NRC is also concerned that

operators and supervisors demonstrated a lack of understanding of the

significance of the event and that your investigation was inadequate because

it failed to determine the root'causes and to identify the corrective actions-

necessary to prevent recurrence. Multiple opportunities existed for you to

identify and determine the root causes of the event and to take adequate

corrective actions prior to the NRC inspection. We are also concerned about

the clarity of procedures which govern fuel movement. Specifically, the use

of words of discretion (e.g., should) for actions that management expects will

be perforned. Operators indicated in discussions with the NRC, that they were

not required to perform actions preceded by the word "should". We understand

that it is your expectation, however, that operators will perform such

actions. . In your response, we request that you outline your plans to ensure j

that your staff understands your expectations and that your expectations are

clearly communicated to your staff. The lack of clear, unequivocal guidance

undermines the intent of a defense in depth strategy.

! You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. The NRC will

use your response, in part, to determine whether further enforcement action is

l necessary to ensure compliance with regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of

this letter, its enclosure (s), and your response will be placed in the NRC ,

Public Document Room (PDR). l
