Safety Evaluation of the Davis-Besse Nuclear Power Station, Unit Number 1, Station Blackout Rule 10 CFR 50.63 (TAC Number 68536)

GentIemen:

By letter dated March 7, 1991 (l.og Number 3421), the Nuclear Regulatory Commission (NRC) transmitted the Safety Evaluation (SE) for compliance with 10 CFR 50.63, the Station Blackout Rule, to Toledo Edison. In this letter, the staff informed Toledo Edison that the Davis-Besse Nuclear Power Station vill be in conformance with 10 CFR 50.63 upon completion of the commitments described in Toledo Edison's submittals of April 19, 1989 (Serial Number 1651), April 2, 1990 (Serial Number 1786) and September 6, 1990 (Serial Numbet 1842). The transmittal letter indicated that implementation of these commitments by the completion of the eighth refueling outage was acceptable.

The transmittal letter requested that Toledo Edison provide a schedule for implementation of any hardware and associated procedure modifications resulting from the recommendations contained in the SE. Since no additlonal hardware changes are necessary to implement the-recommendations, Toledo Edison's compliance date given above remains unchanged.

Based upon Toledo Edison's reviev of the correspondence relating to Station Blackout, there appear to be some discrepancies in the transmittal letter, the SE, and the Technichl Evaluation Report (TER). The attachment to this lettet provides a description of the discrepancies and Toledo Edison's understanding of the actions required for compliance vith 10CFR50.63.

Page 2 of the NRC transmittal letter for the Station Blackout Rule Safety Evaluation states:

"The schedule for implementation presented in your letter dated September 6, 1990, indicates the installation of the alternate AC power source and compliance with 10 CFR 50.63 vill be completed at the end of the eighth refueling outage. This outage is currently scheduled to begin March 1, 1993. The staff finds this implementation schedule acceptable and the requirement of 10 CFR 50.63(b) has been satisfied."

HovcVer, the text of the Safety Evaluation (Section 2.4) states:

"The licensee has stated that the appropriate procedures have been reviewed per guidelines in NUMARC 87-00, Section 4, and vill be revised, if necessary, by the seventh refueling outage.

The implementation of procedure revisions needed to meet the guidelines in NUMARC 87-00 require the installation of the alternate AC power source. In addition, Toledo Edison's letter of September 6, 1990 (Serial letter 1842) was not referenced or considered in the Safety Evaluation. Toledo Edison considers its commitment to have the alternate AC power source installed and affected procedures implemented prior to restart from the eighth refueling outage.

ITEM 2 The Safety Evaluation (Section 3.0) states:

" Based on our reviev of the submittal and site audit, we find the licensee's design and proposed method of dealing with an SB0 to be in conformance with the SB0 rule."

Toledo Edison is unaware of a specific site audit that has been performed addressing Station Blackout.

ITEM 3 Reference (12) of the TER (Section 5.0) is incorrect. The correct Serial Number of the referenced letter is 1786.
