SUBJECT:

SUMMARY

OF MARCH 23, 2004, PUBLIC MEETING WITH STP NUCLEAR OPERATING COMPANY (STPNOC) ON SPECIAL TREATMENT EXEMPTION On March 23, 2004, the U.S. Nuclear Regulatory Commission (NRC) staff met at NRC Headquarters with representatives from STPNOC (the licensee) to discuss STPNOCs experience with the implementation of the Special Treatment exemption granted by the NRC staff in August 2001 for STP Units 1 and 2. Pursuant to the Commissions Policy Statement on Enhancing Public Participation in NRC Meetings, (67 FR 36920), dated May 28, 2002, the meeting was open to the public for observation and opportunity to communicate with the NRC staff following the business portion of the meeting. The meeting notice was issued on March 9, 2004 (accession number ML040690607). A list of discussion topics for the meeting is contained in Enclosure 1 and the list of meeting attendees is contained in Enclosure 2. The presentation slides used by the licensee are accessible on the NRC website www.nrc.gov at the Public Electronic Reading Room in the Agencywide Documents Access and Management System (ADAMS) under ADAMS accession number ML0400830302 and are included as .

The exemptions provided certain relaxations from portions of Parts 21, 50, and 100 of Title 10 of the Code of Federal Regulations (10 CFR) based on STP's methodology for determining the risk significance of structures, systems, and components. The meeting provided STPNOC and Office of Nuclear Reactor Regulation (NRR) and NRC Region IV staffs an opportunity to discuss the status of implementation of the exemptions, lessons learned and actions taken in response to STPNOC's experiences, as well as an overview of comments STPNOC has provided regarding proposed 10 CFR 50.69 "Special Treatment" rulemaking that the staff has undertaken.

AGENDA STPNOC will describe its experience in the implementation of each of the exemptions issued as part of the Special Treatment action dated August 3, 2001 (ML011990368).
