Dear Mr. Koester:

In response to a memorandum from the Office of Environmental Project Review, dated May 6,1981, we have reviewed the subject Revision No. I to Environmental Report (0LS) for Wolf Creek Generating Station, Coffey County, Kansas (ER 80/1586) and offer these comments for your consideration.

General Comments:

We do not have any problems with the revisions and other changes made in this report. We do call to your attention one item that should be dealt with here.

This item, endangered species, is presented below under Specific Comments.

Specific Comments:

Section 7(c) of the Endangered Species Act, as amended, requires the Nuclear Regulatory Comission to obtain from the Fish and Wildlife Service information concerning any species, listed or proposed to be listed, which may be Fesent in the area of the proposed acticn. Therefore, to facilitate compliance with Section 7(c) of the Act, we are furnishing you the following list of species requested by Mr. B. J. Youngblood in his letter of April 30, 1981, which may be present in the concerned area of the Wolf Creek Generating Station, Coffey County, Kansas.

Bald eagle (Haliaeetus leucocechalus)

Peregrine falcon (Falco pereorinus)

The Nuclear Regulatory Commission has the responsibility to review the project and to evaluate the possible effects of construction or, these Federally listed endangered species. The determination to be made on the project is whether the proposed action "may affect or will not affect" listed threatened or endangered species. If it is determined the proposal "may affect" an endangered species, either adversely or beneficially, formal consultationsmust be initiated. However, if it is actermined that the proposal "will not affect" an endangered species, no further action is necessary and the procedure is terminated. The Regional Director, U.S. Fish and Wildlife Service, has the prerogative to request your ager.cy to formally consult on any project if deemed necessary. We would appreciate the opportunity to review the biological assessments you prepare for the two aforementioned Federally endangered species. We request that you contact Mr. Maurice Anderson, Area Endangered Species Coordinator, Pierre Area Office (FTS 782-5226 or Commercial: 605-224-8692) if further assistance is required in making a determination. 2 We suggest the Kansas Fish and Gace Connission be contacted for State threatened or endangered species that may occur in the project area. Your inquiry should be directed to Mr. Marvin Schwilling, 832 East 6th, Emporia, Kansas 66801 or telephone 316-342-0658.
