- This firm represents the Leckenby Company in litigation involving the above-referenced project. Records described below are requested, on their behalf, pursuant to the Freedom of Information Act, 5 U.S.C. S552, as amended by Pub.L.93-502, 88 Stat. 1561.

The term " records" used herein, a's defined in 10 C.F.R.

S9.3(a) (1980), shall mean, "any book, paper, map, photograph, brochure, punch card, magnetic tape, paper tape, sound recording, pamphlet, slide, motion picture or other documentary material regardless of form or characteristics, made by, in the possession of, or under the control of the NRC pursuant to Federal law or in connection with the transaction of public business as evidence of NRC organization, functions, policies , decisions, procedures ,

operations, programs or other activities."

-Be advised-that some records subject to this request may have been obtained by your agency prior to the reorganization of the former Atomic Energy Commission into the presently-existing Nuclear Regulatory Commission. To the extent that records requested herein may technically relate to the former, that distinction shall be deemed irrelevant and those records shall nevertheless be considered as a proper subject of this request.

5. All records concerning the Preliminary Safety Analysis Report required under 10 C.F.R. S50.34 with respect to the referenced project;
6. All. records concerning the Environmental Report required by 10 C.F.R. S51. 20 (a) with respbet to the referenced project;

.. 7. All records regarding any Safety Evaluation issued by the Commission upon completion of its safety review in connection with any construction permit app,lication for the referenced project;

8. All records concerning any revicN conducted by the Advisory Committee on Reactor Safeguards with respect to any construction permit application for the referenced project; I
9. All Supplements, if any, to the Commission's Safety Evaluation with respect-to the referenced project;
10. All Draft Environmental Impact Statements, together with any comments received thereon, regarding the referenced project;
11. All Final Environmental Impact Statements concerning the referenced project; 12.. All records concerning proposed Findings of Fact and Conclusions of Law required by 10 C.F.R. S2.754 regarding proceedings. conducted on construction permit applications with respect to the referenced project;
13. All records.concerning the Initial Decision of the Licensing Board with respect to any construction permit application proceedings for the referenced project;
14. All records concerning any appeals.taken from the Initial-Decision of the Licensing. Board concerning construction penmit applications for the referenced project;

D. Any other non-destructive examinations; and, E. Any destructive examinations.

27. .All correspondence between the Nuclear Regulatory Commission and Washington Public Power Supply System concerning inspections and testing with respect to Contract 2808-215 and Contract 2808-90 for the referenced project;

All statements obtained by the(Nuclear Regulatory Commission-from any'present or former employee of the Leckenby Company, Washington Public Power Supply System, Burns & Roe or any other contractor or subcontractor with respect to its investigation of Contract 2808-215 and Contract 2808-90 for the referenced project;
30. All statements made by any person or organization, other than those specified in the preceding paragraph, obtained by the Nuclear Regulatory Commission in its investigation of Contract 2808-215 and Contract 2808-90;
31. Identification of any stenographic reports or non-

- stenographic recordings made by the Nuclear Regulatory Commission during its investigation of contract 2808-215 and Contract 2808-90 for the referenced-project, together with copies of all transcripts made therefrom;

32. All'NRC findings, conclusions or reports made pursuant to 10 C.F.R. S50 involving compliance or non-compliance with

-quality assurance / quality control requirements by the Washington Public Power. Supply System on either Contract 2808-215 (sacrificial shield wall) or Contract 2808-90 (pipe whip restraints) for the

_ referenced project;

33. All NRC findings, conclusions or reports made pursuant to 10 C.F.R. S50 involving compliance or non-compliance with quality assurance / quality control requirements by Burns & Roe on either Contract 2808-215 or Contract 2808-90 for the referenced project;
34. All NRC findings, conclusions or reports made pursuant to 10 C.F.R. S50 involving compliance or non-compliance with quality assurance / quality control requirements by any contractor or subcontractor on either Contract 2808-215 or Contract 2808-90 for the referenced project;
35. Aay change in requirements published or imposed by the Nuclear Regulatory Commission subsequent to the Three-Mile Island incident and imposed upon the referenced project with respect to Contract 2808-215 (sacrificial shield wall) and Contract 2808-90 (pipe whip restraints).
36. All_ records, including, but not limited to, reports, -

letters, findings and conclusions, either obtained or issued by the Nuclear Regulatory Commission in its investigation of Contract 2808-215 which relate to:

A. Design deficiencies in the sacrificial shield wall; _, _

l B. Stress fractures involving either the steel or the welds on the sacrificial shield wall; and, C. Design changes with respect to the sacrificial shield wall made by either the Washington Public Power Supply System or its design engineer, Burns & Roe.

As you know, the Freedom of Information Act requires your response to this request within 10 days after its receipt by you.

If access is denied to any part of the requested records, please describe the deleted material in detail, specify the statutory basis for the denial and explain the reason for your belief that the alleged statutory justification applies in this instance. If you determine that some portion or portio ~ns of the requested records are exempt from disclosure, it is requested that you provide copies of the remainder thereof to this office immediately.
