Gentlemen On January 18, 1985, Susan C. Remis, Assistant Deputy Public Advocate, counsel for the Intervenor, wrote to the Licensing Board to confirm a telephone conversation with the three members of the presiding Atomic Safety and Licensing Board. For the Board's information, counsel for the Public Advocate never contacted the Applicants regarding any telephone call with the Licensing Board. It is impossible to tell from the letter whether any substantive matters were discussed. However, Applicants certainly would like to have been heard before the Board, according to the account of Ms.

Remis, " clarified that all discovery must be completed by January 31, 1985 even if a party does not have a full two weeks to respond to interrogatories."

We would hope that the Board would discourage any contact with any party without reasonable efforts having previously been made to contact all counsel with regard to the subject matter of the contact. We believe this procedure is fundamental to fairness to all parties and in

Applicants ask that the Licensing Board verify the correctness of the statements made in counsel's letter as to the Board's statements on the conference call and discuss any other matter which may have arisen so that Applicants may have an opportunity to respond.
