4 ASME(Boiler and Pressure Vessel Code,Section XI, requires that-an outside diameter (OD)--surface and volumetric examination be conducted of the velds ~

at the terminal ends'of piping runs connected to vessels. Toledo Edison's  !

letter to the Nuclear: Regulatory Commission (NRC) dated December 7,1989

~

(Serial Number 1740)1 requested approval of an alternate examination method pursuant to'10 CFR 50.55a (a)(3) and (g)(5)(iii). Toledo Edison requested j approval'of the proposed alternative by January 31, 1990 in order to '

. facilitate scheduling of the examination during the sixth refueling outage which'is anticipated to begin in early February.

a Toledo Edison's December 7,1989 letter included a Babcock and Vilcox (B&W) drawing illustrating:the calibration block used for demonstration of

.. the proposed alternate examination method. The drawing was annotated indicating that it is the property of B&V and that it is not to be

.rgroduced or used for furnishing information to others or for any other purpose detrimental to the interests of B&V. Toledo Edison was informed on December 21, 1989 by telephone that this note was preventing the letter from being distributed within the NRC because of the apparent proprietary nature of the drawing and that NRC reviev vould not commence until this is resolved..

Toledo Edison considers that any liability associated with the reproduction of this drawing by the NRC is solely Toledo Edison's. '

.Nonetheless, Toledo Edison has confirmed with B&W that no restrictions on reproduction of the drawing are required. However, to alleviate any NRC concerns regarding the reproduction of the drawing, Toledo Edison submits this letter and the enclosed replacement drawing. Toledo Edison requests that the enclosed drawing be substituted for the drawing included with Serial Number 1740.
