REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DI

Dear Mr. Kelly:

By )|letter dated March 18,1999]], Florida Power Corporation submitted a revised license amendment request, which included Framatome Technologies incorporated (FTI) Topical Report BAW-2342P, Revision 0. "OTSG Repair Roll Qualification Report, Addendum A", and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. A nonproprietary version was also submitted for placement in the public document room.

An affidavit dated March 17,1999, executed by yourself for FTI, the owner of the information, was included in the application. You stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

(a) The information reveals data or material concerning FTl research or development plans or programs of present or potential competitive advantage to FTI.

i (B) The use of the information by a competitor would decrease his expenditures, in  !

time or resources, in designing, producing or marketing a similar product.

(c) The information consists of test data or other similar data concerning a process, method or component, the application of which results in a competitive advantage to FTI.

We have reviewed your affidavit and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted j

information sought to be withheld contains trade secrets or proprietary commercial information and should be withheld from public disclosure.  !

Therefore, we have determined that the FTl Topical Report BAW-2342P, Revision 0, entitled "OTSG Repair Roll Qualification Report, Addendum A," marked as proprietary, will be withheld '

from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended. (~

i Withholding from public inspection shall not affect the right, if any, of persons properly and directly concemed to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
