On October 7, 1980, Metropolitan Dade County, Florida filed a motion for leave to participate in this proceeding under 10 CFR 52.715(c). A resolution of the Board of County Commissioners, dated September 2, 1980 authorizing such action was attached to the motion. Turkey Point Nuclear Generating Units Nos. 3 and 4 are located in Dade County. Neither the motion nor. the resolution refers to the extreme tardiness of the petition nor is any reason given for the action of the county commissioners at this late d'ate other than to state their issues of interest.

Florida Power & Light did.not respond to the motion. The NRC Staff filed in support of the motion on October 7, 1980.

Based on the Commission Memorandum and Order in West Ville concerning the late intervention of Erie County, New York, whose tardiness lacked merit, we grant the motion and accept Metropolitan

Dade County under 10 CFR 52.715(c) .in this proceeding.*/ The

-County must accept the proceeding at its present status. All filings and orders to date are located in the local document room--Library of Environmental and Urban Affairs, -Florida International University, Miami, Florida.

MOTION FOR LEAVE TO PARTICIPATE PURSUANT TO RULE 2. 715 c OF THE UNITED STATES NUCLEAR REGULATORY COMMISSION RULES AND REGULATIONS, RULES OF PRACTICE FOR DOMESTIC LICENSING PROCEEDINGS Petitioner, METROPOLITAN DADE COUNTY, a political subdivision of the State of Florida, by and through its undersigned counsel, hereby files this Motion for Leave to Participate Pu.suant to Rule 2.715(c) before this Honorable Board, and alleges as grounds therefor, the following:

1. On September 2, 1980, the Board of County Commissioners of Dade County unanimously adopted a resolution directing the County Attorney's Office to petition the Atomic Safety and Licensing Board for leave to participate pursuant to Rule 2. 715(c), said resolution being attached hereto and made a part hereof.
2. Rule 2. 715 (c) provides in pertinent part, that an agency such as Dade County shall have a "a reasonable opportunity

~o participate and to introduce evidence, interrogate witnesses, I

and advise the commission without requiring the representat've to take a position with respect to the issue. Such participants may also file proposed findings and exceptions pursuant to Sections 2.754 and 2.762 and petitions for review by the commission pursuant to Section 2.786".

3. Review of the Environmental Impact Appraisal by the Office of Nuclear Reactor Regulation and the Sazety Evaluation by the Office of Nuclear Reactor Regulation, and amendments thereto, and review of the Environmental Impact Statement is likely.to reveal areas oz unique concern to petitioner.

Petitioner would reserve its right to raise issues upon review of said documents.

NHEREFORE, your Petit'oner, I1ETROPOLITAN DADE COUN Y, respectfully requests that this Board permit petitioner to participate in all hearings in reference to the repairs at, the Turkey Point Nuclear Generating Unit Nos. 3 and 4, as provided .

DPR-31 and DPR-41, which authorize the operation of the Turkey Point Plant, Unit Nos. 3 and 4 at steady state reactor power levels not in, excess of 2200 megawatts thermal (rated power).

Each facility consists of a pressurized water reactor located at the licensee's site in Dade County near Miami, Florida.

On November 4, 1977, the Union of Concerned Sci ent i sts (UCS) filed with the Commission a "Petition for Emergency and'Remedial Relief." The petition sought action in two areas: fire protection for electrical cables, and environmental qualification of electrical components. By Memorandum and Order dated April 13, 1978 (7 NRC 400), the Commission denied certain aspects of the petition and, with respect to other aspects, ordered the NRC staff to take several related actions. UCS filed a Petition for Reconsideration on May 2, 1978. By Memorandum and Order, dated May 23, 1980, the Commission reaffirmed its April 13, 1978 decision

regarding the possible shutdown of operating reactors. However, the Commission's Nay 23, 1980 decision directed licensees and the HRC staff to undertake certain actions.

With respect to environmental qualification of safety-related electri~~l equipment, the Comnission determined that the provisions of the two staff documents the Division of Operating Reactors "Guidelines for Evaluating Environmental gualification of Class lE Electrical Equipmet in Operating Reactors" (DOR Guidelines) and HUREG-0588, "Interim Staff Position on Environmental gualification of Safety-Related Electrical Equipment," December 1979 "form the requirements which licensees and applicants must meet in order to satisfy those aspects of 10 CFR part 50, Appendix A General Design Criterion (GDC-4), which relate to environ mental qualification of safety-related electrical equipment."

Commission directed, for replacement parts in operating plants, "unless there are sound reasons to the contrary, the 1974 standard in NUREG 0588 will apply." The Comnission also directed the staff to complete its 1

review of the information sought from licensees by Bulletin 79-018 to complete its review of environmental qualification of safety-re]ated electrical equipment in all operating plants, including the publication of Safety Evaluation Reports, by Februarv 1, 1981. The Commission 1

imposed a deadline that, "by no later than June 30, 1982

The Commission requested the staff to, "keep the Conrnission and the public apprised of any further findings of incomplete environmental qualification of safety-related electrical equipment, along with corrective actions taken or planned,"

and requested the staff to provide bi-monthly progress reports to the Commission.

The Comnission further directed the staff to add certain documentation requirements to each license after the specific requirements were approved by the Commission. The Comnission also pointed out that the various deadlines imposed in its Order, "do not excuse a licensee from the obligation to modify or replace inadequate equipment promptly."

'he information developed during this proceeding emphasizes the importance of adequate documentation, the prompt completion of the review of environ-mental qualification of safety-related electrical equipment, and the prompt completion of any plant modification needed to assure conformance with the DOR Guidelines or i<UREG-0588. A significant aspect of this review is the timely submittal of environmental qualification information by the operating plant licensees to enable the staff to complete its review in accordance with the Comnission's Order. The staff has a program presently underway to reevaluate, using the DOR Guidelines and hUREG-0588, the oualifications of safety-related electrical equipment exposed

to environments that may exist following postulated accidents. These accidents are Loss of Coolant Accident and Main Steam Line Break inside containment, and High Energy Line Breaks inside and outside containment.

In this connection the licensee was requested by ICE Bulletin 79-018 of January 14, 1980 to provide a detailed revi ew of the environmental qualification of Class lE electrical equipment. This revi ew was to include all equipment required to function under postulated accident conditions, both inside and outside the primary containment, and recognize all condi-tions specified in the bulletin. Evidence of qualification together with methods and justification, was requested.

Clarification was provided by supplemental information, briefings, and in some cases, meetings with the licensee. Timely completion of the staff's review of environmental qualification of electrical equipment and timely completion of needed modifications by the licensee is required to provide continuing reasonable assurance of public health and safety. Such completion is dependent on the prompt receipt of a complete response by the licensee to the staff's requests for information.

IV.

Accordingly, pursuant to the Atomic Energy Act of 1954, as amended, and the Commission's regulations in 10 CFR Parts 2 and 50, IT IS ORDERED THAT EFFECTIVE IMMEDIATELY Facility Operating License Nos. DPR-31 and DPR-41 are hereby amended to add the following provisions:

"Information which fully and completely responds to the staff's request as specified in I 8 E Bulletin.79-01B, shall be submitted to the Director, Region II, Office of Inspection and Enforcement, by the licensee, not later than November 1, 1980."

An earlier response is encouraged to facilitate staff review and issuance of the safety evaluation report. The licensee or any person whose interest I

may be affected by this Order may request a hearing within 20 days of the date of publication of this Revised Order in the Federal ~Re ister.

Any request for a hearing will not stay the effective date of this Order.

Any request for a hearing shall be addressed to the Director, Office of Nuclear Reactor Regulation, U. S. Nuclear Regulatory Commission, Washington, D. C. 20555. A copy of the request should also be sent to the Executive Legal Director, U. S. Nuclear Regulatory Commission, Washington, D. C. 20555, and to Hr. Robert Lowenstein, Esquire, Lowenstein, Newman, Reis and Axelrad, 1025 Conecticut Avenue, N.W., Suite 1214, Washington, D. C. 20036, attorney for the licensee.

If a hearing is held concerning this Order, the issue to be considered at the hearing shall be whether the licenses should be modified to require submission of information as set forth in Section IV. of the Order.

Operating of the facilities on terms consistent with this Order is not'tayed by the pendency of any proceedings on the Order. This Order revises, in its entirety, the Order issued August 29, 1980, and published in the Federal ~Re ister September ll, 1980, (45 FR 60057).
