N Gentlemen:

This is to advise that the State of Texas and the Appli-cant have been meeting in an effort to resolve concerns which have been raised by the State with respect to the Allens Creek project. As of this date, issues involv-ing the decommissioning have not been fully resolved.

The Applicant and the State are continuing in their ef-forts to resolve this matter outside the hearing process.

Accordingly, the State agrees not to file any conten-tion dealing with decommissioning at this time. The Applicant agrees not to object to any later submission of the decommission issue on the grounds of timeliness, if the State and the Applicant are unable to reach an accomodation. The Applicant does reserve all other objections.
