The Nuclear Regulatory Commission staff will hold a pre-decisional enforcement conference with representatives of Roxar Flow Measurement, Inc., of Houston, Texas, on November 15 to discuss an apparent violation of NRC requirements involving the sale and use of 27 gauges containing radioactive material to users not authorized to receive them.

The conference will begin at 9 a.m. in the NRCs Region IV office, 612 East Lamar Blvd., Arlington, Texas. During the conference the company will have an opportunity to address the apparent violation. The public is invited to observe the meeting. NRC officials will be available to answer questions from the public after the business portion of the meeting.

The company holds an NRC license authorizing it to possess gauges containing radioactive material. An NRC inspection found that the company sold and then shipped 27 gauges to users not authorized to receive them where they remain. The gauges measure the flow of oil in undersea pipelines.

The gauges have been used safely and securely by the customers of the licensee since the gauges were installed on pipelines below the surface of the Gulf of Mexico. No radiation exposures or loss of control of radioactive material occurred due to the purchase and use of the gauges by the customers.

The decision to hold a pre-decisional enforcement conference does not mean that a final determination has been made that violations have occurred or that enforcement action will be taken. The purpose is to discuss the apparent violations, causes and safety significance, to provide the licensee with an opportunity to point out any errors, if any, in the NRC inspection report and to enable the company to outline its corrective actions.

No decision on the apparent violations or any contemplated enforcement action, such as a civil penalty, will be made at the conference. Those decisions will be made by NRC officials at a later date.
