W. Jessup Meeting Summary:

The U.S. Nuclear Regulatory Commission (NRC) staff conducted the meeting in accordance with NRC Management Directive 3.5, Attendance at NRC Staff-Sponsored Meetings (ML21180A271). Highlights from the meeting include the following:

The NRC staff previously met with Oklo to discuss its approach to plant operations and the roles of operators on August 31, 2022 (ML22257A245). At that time, the staff stated that it would be helpful to have additional discussions during the pre-application phase on this topic. The purpose of the August 8, 2023, meeting was for Oklo provide further operations-related information regarding the design as a continuation of prior discussions.

The staff noted that there are multiple regulatory matters associated with Oklos proposed approach to operations that would be worthy of future discussion during pre-application to align on resolution strategy. The staff recommended further discussions as early as is practical before submittal of a license application so that these matters can be fully considered. For example, the staff would like to have future discussions on the planned implementation of the shift technical advisor role, including any differences from current Commission policy. The staff also noted that additional discussions would be helpful on technically relevant post-Three Mile Island requirements in 10 CFR 50.34(f)(2)(iii), which addresses the application of the state-of-the-art in human factors engineering.

The staff emphasized that through tools such as exemptions and licensing commitments related to alternatives, there is flexibility available for advanced reactor vendors and encouraged further engagement on these topics.

The staff also discussed draft Interim Staff Guidance (ISG) DANU-ISG-2022-05, Advanced Reactor Content of Application Project Chapter 11 - Organization and Human-System Considerations, (ML22048B542) which covers operator licensing examination programs. This ISG was developed to support the draft proposed 10 CFR Part 53, Risk-Informed, Technology-Inclusive Regulatory Framework for Advanced Reactors, rule, but can also serve to inform the thinking of advanced reactor applicants that would apply under 10 CFR Part 50, Domestic Licensing of Production and Utilization Facilities, or 10 CFR Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants, before 10 CFR Part 53 is issued as a final rule.
