Meeting Summary:
The U.S. Nuclear Regulatory Commission (NRC) staff conducted the meeting in accordance with NRC Management Directive 3.5, Attendance at NRC Staff-Sponsored Meetings (ML21180A271). Highlights from the meeting included the following:
The following three topics were discussed during the April 21, 2023, meeting:
o Status of pre-application activities, o Oklos intended path to closure of pre-application discussion on certain items related to safety classification, and o Preliminary NRC staff feedback on draft white papers (WPs) related to safety-related compliance, safety classification, and regulatory controls.
The NRC staff and Oklo discussed environmental issues, principal design criteria (PDC),
seismic design and site characterization, and physical security as part of the broader discussion on pre-application engagement activity status updates.
o The NRC staff agreed to schedule a separate meeting between Oklo and NRC staff in the Office of Nuclear Material Safety and Safeguards to discuss matters related to Oklos forthcoming environmental report.
o The NRC staff and Oklo discussed the General Design Criteria (GDC) found in Appendix A, General Design Criteria for Nuclear Power Plants, to Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Domestic Licensing of Production and Utilization Facilities, and how the GDC provide guidance for establishing PDC for non-water-cooled nuclear power plants.
o The NRC staff encouraged Oklo to formally submit a WP on the topic of seismic design and site characterization to obtain written NRC staff feedback on its proposed approach for addressing these areas in a future license application.
o Oklo shared its plans for addressing physical security in its proposed advanced reactor design and indicated that it may be helpful to schedule an additional meeting on this topic in the future.
In January 2023, Oklo shared a draft WP entitled, Safety-Related Compliance -
Approach to Safety Classification (draft). In February 2023, the NRC staff shared four questions regarding this draft WP and indicated that these four questions should be used as the basis for future discussions on regulatory controls. During the April 21, 2023, meeting, Oklo provided responses to these four questions. The NRC staff acknowledged Oklos responses and stated it will consider this information as it reviews the WP when it is submitted.
On April 12, 2023, Oklo shared draft WPs entitled Safety Classification Overview and Regulatory Controls Example. At the April 21, 2023, meeting, the NRC staff also provided preliminary feedback regarding these draft WPs. The NRC staff identified several areas where it would need clarification to fully understand Oklos approach.
